The bill covers these issues from a few angles \u2014 here\u2019s what the regulation is trying to address, and how it could set the tone for future state or federal legislation.<\/p>\n<h2 class=\"wp-block-heading\">AI-driven firings<\/h2>\n<p>SB 947, somewhat cheekily called the \u201cNo Robo Bosses Act,\u201d prohibits employers from outsourcing disciplinary and termination decisions entirely to AI, referred to in the bill as automated decision systems (ADS). The bill requires employers to check any AI decisions on employee discipline or termination, as well as provide the employee with a description of the reasons for the decision. That includes any data used to make the decision, including personnel files, evaluations, work product, peer reviews, and \u201cwitness interviews.\u201d <\/p>\n<p>\u201cIf an employer cannot corroborate the ADS output or the human reviewer has concluded that the ADS output is inaccurate, incomplete, or misleading, the employer shall not use the ADS output to make a disciplinary or termination decision,\u201d the bill states. <\/p>\n<p><strong>Also: <a href=\"https:\/\/www.zdnet.com\/innovation\/ai-career-ladder-new-ways-to-top\/\">AI just broke your career ladder \u2013 here are 6 new ways to the top<\/a><\/strong><\/p>\n<p>The law, which goes into effect on July 1, 2027, lets affected employees file complaints with the California Labor Commissioner if they believe this process was not followed correctly in a firing decision. It does not fully prohibit the use of automated systems for these determinations. It also requires employers to clarify whether \u201ca mass layoff, relocation, or termination is caused by an AI system,\u201d according to a <a href=\"https:\/\/www.gov.ca.gov\/2026\/09\/30\/californias-nation-leading-ai-framework-just-got-stronger-governor-newsom-signs-more-first-in-the-nation-worker-protections-and-more\/\" target=\"_blank\" rel=\"noopener\">brief<\/a> on the governor\u2019s website.<\/p>\n<p>While AI regulation at the federal level remains less specific, mired in voluntary agreements with labs, and arguably <a href=\"https:\/\/mashable.com\/tech\/white-house-accord-on-super-intelligence-explained\" target=\"_blank\" rel=\"noopener\">focused on distractions<\/a>, states have risen to the challenge of creating initial protections for workers. Still, when it comes to AI in hiring and other workplace processes, some states like Colorado and Connecticut have opted for mandating <a href=\"https:\/\/news.bloomberglaw.com\/daily-labor-report\/colorado-joins-states-favoring-ai-disclosure-over-audit-mandates\" target=\"_blank\" rel=\"noopener\">disclosure of AI use<\/a> rather than actual intervention.<\/p>\n<p>California and New York have <a href=\"https:\/\/www.zdnet.com\/article\/state-ai-safety-laws-california-new-york\/\">tended to lead the charge<\/a> on stricter laws, though Illinois <a href=\"https:\/\/www.skadden.com\/insights\/publications\/2026\/07\/illinois-enacts-ai-safety-law-becoming-first-state\" target=\"_blank\" rel=\"noopener\">passed a landmark bill<\/a> this summer, becoming the first state to require third-party audits of frontier labs. <\/p>\n<p><strong>Also: <a href=\"https:\/\/www.zdnet.com\/article\/73-of-tech-job-listings-require-ai-skills-show-off-yours\/\">73% of tech job listings require AI skills now: How to show off yours<\/a><\/strong><\/p>\n<p>Lily Li, a lawyer specializing in AI and founder of Metaverse Law, told ZDNET she sees California\u2019s latest law setting the precedent for other states. But she also anticipates companies finding loopholes in the law\u2019s required human review process. <\/p>\n<p>\u201cWe could see employers engaging in check-the-box reviews rather than meaningful human review, to avoid the operational costs of an additional layer of review,\u201d she said. \u201cThe ability for an employee to request an explanation is a helpful check against this, however.\u201d<\/p>\n<p>With that concern, it\u2019s possible the onus of tackling unvetted AI-driven firings will fall on complainants contesting their own firings in court.
