It limits foreign adversaries from collecting data through adversary-controlled software applications. In March, then head of NSA Cybersecurity Rob Joyce called TikTok <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2023\/03\/29\/china_tiktok_trojan_horse\/\" rel=\"noopener\">China&#8217;s &#8220;Trojan horse.&#8221;<\/a><\/p>\n<p>More recently, US authorities have alleged active data gathering. The US Justice Department in a July court filing <a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/apnews.com\/article\/tiktok-bytedance-censorship-us-data-240e11d9bb6212b0c9b1adab821e5005\">accused<\/a> ByteDance and TikTok of using an internal tool called Lark to allow TikTok employees in the US to communicate with ByteDance engineers in China and provide them with US users&#8217; sensitive personal information.<\/p>\n<div aria-hidden=\"true\" class=\"adun\" data-pos=\"top\" data-raptor=\"falcon\" data-xsm=\",fluid,mpu,\" data-sm=\",fluid,mpu,\" data-md=\",fluid,mpu,\"> <noscript> <a href=\"https:\/\/pubads.g.doubleclick.net\/gampad\/jump?co=1&amp;iu=\/6978\/reg_onprem\/personaltech&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=4&amp;c=44Z1RaJ4a-e52SawV7Otv1TgAAAZM&amp;t=ct%3Dns%26unitnum%3D4%26raptor%3Dfalcon%26pos%3Dmid%26test%3D0\" target=\"_blank\" rel=\"noopener\"> <img decoding=\"async\" src=\"https:\/\/pubads.g.doubleclick.net\/gampad\/ad?co=1&amp;iu=\/6978\/reg_onprem\/personaltech&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=4&amp;c=44Z1RaJ4a-e52SawV7Otv1TgAAAZM&amp;t=ct%3Dns%26unitnum%3D426raptor%3Dfalcon%26pos%3Dmid%26test%3D0\" alt> <\/a> <\/noscript> <\/div>\n<p>ByteDance, incorporated in the Cayman Islands but headquartered in China, <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2024\/05\/07\/tiktok_bytedance_sue_usa\/\" rel=\"noopener\">challenged<\/a> the constitutionality of the law in May.<\/p>\n<p>&#8220;Banning TikTok is so obviously unconstitutional, in fact, that even the act\u2019s sponsors recognized that reality, and therefore have tried mightily to depict the law not as a ban at all, but merely a regulation of TikTok\u2019s ownership,&#8221; the companies said in their <a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/sf16-va.tiktokcdn.com\/obj\/eden-va2\/hkluhazhjeh7jr\/AS%20FILED%20TikTok%20Inc.%20and%20ByteDance%20Ltd.%20Petition%20for%20Review%20of%20H.R.%20815%20(2024.05.07)%20(Petition).pdf?x-resource-account=public\">lawsuit<\/a> [PDF].<\/p>\n<p>On Friday, a three-judge panel for the US Court of Appeals for the District of Columbia Circuit unanimously disagreed, finding the Justice Department&#8217;s national security argument valid.<\/p>\n<p>&#8220;The government provides persuasive support for its concerns regarding the threat posed by the PRC [People&#8217;s Republic of China] in general and through the TikTok platform in particular,&#8221; the <a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cadc.40861\/gov.uscourts.cadc.40861.1208687460.0_1.pdf\">appellate ruling<\/a> [PDF] says, noting that the objections raised by ByteDance and TikTok are insufficient.<\/p>\n<p>&#8220;[T]he bottom line is that they fail to overcome the government\u2019s considered judgment and the deference we owe that judgment,&#8221; the ruling says.<\/p>\n<div aria-hidden=\"true\" class=\"adun\" id=\"story_eagle_xsm_sm_md_xmd_lg_xlg\" data-pos=\"mid\" data-raptor=\"eagle\" data-xsm=\",mpu,dmpu,\" data-sm=\",mpu,dmpu,\" data-md=\",mpu,dmpu,\" data-xmd=\",mpu,dmpu,\" data-lg=\",mpu,dmpu,\" data-xlg=\",mpu,dmpu,\"> <noscript> <a href=\"https:\/\/pubads.g.doubleclick.net\/gampad\/jump?co=1&amp;iu=\/6978\/reg_onprem\/personaltech&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=3&amp;c=33Z1RaJ4a-e52SawV7Otv1TgAAAZM&amp;t=ct%3Dns%26unitnum%3D3%26raptor%3Deagle%26pos%3Dmid%26test%3D0\" target=\"_blank\" rel=\"noopener\"> <img decoding=\"async\" src=\"https:\/\/pubads.g.doubleclick.net\/gampad\/ad?co=1&amp;iu=\/6978\/reg_onprem\/personaltech&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=3&amp;c=33Z1RaJ4a-e52SawV7Otv1TgAAAZM&amp;t=ct%3Dns%26unitnum%3D3%26raptor%3Deagle%26pos%3Dmid%26test%3D0\" alt> <\/a> <\/noscript> <\/div>\n<p>ByteDance and TikTok intend to appeal to the US Supreme Court.<\/p>\n<p>&#8220;The Supreme Court has an established historical record of protecting Americans&#8217; right to free speech, and we expect they will do just that on this important constitutional issue,&#8221; said TikTok spokesperson Michael Hughes in a statement provided to <em>The Register<\/em>.<\/p>\n<p>&#8220;Unfortunately, the TikTok ban was conceived and pushed through based upon inaccurate, flawed and hypothetical information, resulting in outright censorship of the American people. The TikTok ban, unless stopped, will silence the voices of over 170 million Americans here in the US and around the world on January 19, 2025.&#8221;<\/p>\n<p>TikTok could get a reprieve from the incoming administration, however. President-elect Trump, during his first term, tried to ban TikTok. But during his recent presidential campaign, he <a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/www.washingtonpost.com\/business\/2024\/11\/12\/trump-tiktok-ban-sale\/\">promised<\/a> to save it, perhaps largely so that Mark Zuckerberg&#8217;s Meta doesn&#8217;t get more of a monopoly over US social media.<\/p>\n<p>In March this year, Trump, on his own ironically named Truth Social, declared without evidence: &#8220;I don&#8217;t want Facebook, who cheated in the last election, doing better,&#8221; adding: &#8220;They are a true enemy of the people.&#8221;<\/p>\n<p>Then again, he could change his mind.<\/p>\n<p>If ByteDance is forced to divest but no acceptable buyer can be found, Oracle, which provides IT services to TikTok in the US, has warned its revenue could suffer. In a June <a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/www.sec.gov\/ix?doc=\/Archives\/edgar\/data\/1341439\/000095017024075605\/orcl-20240531.htm\">SEC filing<\/a>, the database titan said, &#8220;If we are unable to provide those services to TikTok, and if we cannot redeploy that capacity in a timely manner, our revenues and profits would be adversely impacted.&#8221;
