But the Federal Trade Commission (FTC) found otherwise.&nbsp;<\/p>\n<p><strong>Also:&nbsp;<a href=\"https:\/\/www.zdnet.com\/article\/click-to-cancel-violators-will-face-consequences-as-us-agency-vows-to-enforce-ftc-ruling\/\">&#8216;Click-to-cancel&#8217; violators will face consequences, as US agency vows to enforce FTC ruling<\/a><\/strong><\/p>\n<p>Last week, the FTC&nbsp;<a href=\"https:\/\/www.ftc.gov\/news-events\/news\/press-releases\/2024\/11\/ftc-takes-action-against-evolv-technologies-deceiving-users-about-its-ai-powered-security-screening\" target=\"_blank\" rel=\"noopener nofollow\" class=\"c-regularLink\">proposed a settlement order<\/a>&nbsp;with Evolv Technologies over how the company oversold the ability of its AI-powered security system to detect weapons and &#8220;ignore harmless personal items&#8221; &#8212; especially in school settings. Evolv&#8217;s touch-free systems scan people as they enter a space without requiring a manual search of bags or pockets.&nbsp;<\/p>\n<p>In an <a href=\"https:\/\/x.com\/linakhanFTC\/status\/1861469897269575787?ref_src=twsrc%5Egoogle%7Ctwcamp%5Eserp%7Ctwgr%5Etweet\" target=\"_blank\" rel=\"noopener nofollow\" class=\"c-regularLink\">X post<\/a>, FTC chair Lina Khan said Evolv has &#8220;falsely hyped&#8221; its AI weapons detection systems to school districts that paid the company &#8220;millions&#8221; to use the technology in schools. She noted that the scanners set off alarms for harmless items such as water bottles and binders while failing to identify weapons.&nbsp;<\/p>\n<figure class=\"c-shortcodeTwitterTweet\">\n<div readability=\"6.510736196319\">\n<blockquote class=\"twitter-tweet\" readability=\"6.9447852760736\">\n<p lang=\"en\" dir=\"ltr\">1. Evolv falsely hyped its AI-powered security screening systems to school districts that then paid it millions of dollars.<br \/>In reality, Evolv&#8217;s scanners sometimes failed to detect weapons in schools while setting off alarms for binders and water bottles. <a href=\"https:\/\/t.co\/JFonOYEoyA\">pic.twitter.com\/JFonOYEoyA<\/a><\/p>\n<p>\u2014 Lina Khan (@linakhanFTC) <a href=\"https:\/\/twitter.com\/linakhanFTC\/status\/1861469897269575787?ref_src=twsrc^tfw\">November 26, 2024<\/a><\/p><\/blockquote><\/div>\n<\/figure>\n<p>Since going public in 2021, Evolv&#8217;s scanners have been popping up at&nbsp;<a href=\"https:\/\/www.zdnet.com\/article\/this-ai-system-will-completely-change-your-experience-at-sporting-events\/\">sporting events<\/a>,&nbsp;<a href=\"https:\/\/www.theverge.com\/2024\/5\/13\/24155861\/evolv-scanners-ai-gun-detection-nyc-subway-disney-eric-adams\" target=\"_blank\" rel=\"noopener nofollow\" class=\"c-regularLink\">theme parks<\/a>, schools,&nbsp;<a href=\"https:\/\/www.zdnet.com\/article\/end-to-airport-security-lines-new-us-trials-set-for-ai-powered-body-scanners\/\">airports<\/a>, subway stations, and even&nbsp;<a href=\"https:\/\/evolv.com\/resources\/press-releases\/lincoln-center-for-the-performing-arts-enhances-security\/\" target=\"_blank\" rel=\"noopener nofollow\" class=\"c-regularLink\">film festivals<\/a>&nbsp;as an alternative to traditional metal detectors and other forms of security checkpoints. The Massachusetts-based company has advertised its &#8220;advanced AI-powered security scanning systems&#8221; as a viable solution to address public safety concerns, including school shootings.&nbsp;<\/p>\n<p><strong>Also:&nbsp;<a href=\"https:\/\/www.zdnet.com\/article\/ftc-report-exposes-massive-data-collection-by-social-media-brands-how-to-protect-yourself\/\">FTC report exposes massive data collection by social media brands &#8211; how to protect yourself<\/a><\/strong><\/p>\n<p>According to <a href=\"https:\/\/theintercept.com\/2023\/05\/07\/ai-gun-weapons-detection-schools-evolv\/\" target=\"_blank\" rel=\"noopener nofollow\" class=\"c-regularLink\">The Intercept<\/a>, in June 2022, former Evolv chief executive Peter George was asked at an investor conference &#8220;if the company would have stopped the tragic school shooting in Uvalde, Texas, where 19 students and two teachers were killed.&#8221;&nbsp;<\/p>\n<p>George answered, &#8220;When somebody goes through our system and they have a concealed weapon or an open carry weapon, we&#8217;re gonna find it, period.&#8221;&nbsp;<\/p>\n<p><!----><\/p>\n<p>Despite Georges&#8217;s declaration, dozens of school districts that spent millions on gun detection technology <a href=\"https:\/\/theintercept.com\/2023\/05\/07\/ai-gun-weapons-detection-schools-evolv\/\" target=\"_blank\" rel=\"noopener nofollow\" class=\"c-regularLink\">experienced instances of Evolvs&#8217; systems not detecting weapons<\/a>, according to the Intercept, resulting in legal and <a href=\"https:\/\/www.reuters.com\/technology\/crowd-safety-firm-evolv-under-us-ftc-scanner-over-marketing-practices-2023-10-13\/\" target=\"_blank\" rel=\"noopener nofollow\" class=\"c-regularLink\">regulatory scrutiny<\/a>. In 2023, five law firms <a href=\"https:\/\/ipvm.com\/reports\/evolv-law-investigate\" target=\"_blank\" rel=\"noopener nofollow\" class=\"c-regularLink\">announced<\/a> investigations into Evolv technologies for possible violations of securities law, claiming that &#8220;Evolv misled investors over the capabilities of its weapons detectors.&#8221;&nbsp;<\/p>\n<p><strong>Also:&nbsp;<a href=\"https:\/\/www.zdnet.com\/article\/why-you-should-power-off-your-phone-once-a-week-according-to-the-nsa\/\">Why you should power off your phone once a week &#8211; according to the NSA<\/a><\/strong><\/p>\n<p>Moreover, Evolv&#8217;s shareholders <a href=\"https:\/\/www.404media.co\/shareholders-sue-evolv-ai-weapon-detecting-company-because-it-fails-to-detect-weapons\/?ref=hellgatenyc.com\" target=\"_blank\" rel=\"noopener nofollow\" class=\"c-regularLink\">filed a class-action suit<\/a> against the company, arguing that the company&#8217;s marketing claims overstated the effectiveness of the technology.&nbsp;<\/p>\n<p>The issues don&#8217;t stop there. Despite this legal, regulatory, and internal turmoil, New York City Mayor Eric Adams launched a three-month pilot program that would deploy the AI scanners in NYC subways. The same scanners had been deployed previously in Jacobi Medical Center, where they reportedly triggered a&nbsp;<a href=\"https:\/\/hellgatenyc.com\/new-subway-security-theater-just-dropped-controversial-ai-weapons-scanner\/\" target=\"_blank\" rel=\"noopener nofollow\" class=\"c-regularLink\">huge number of false positives<\/a>, according to NYC-based news outlet Hell Gate.&nbsp;<\/p>\n<p>It&#8217;s common for AI systems to get better over time, as models can become more accurate the more data they accumulate. For Evolv, that wasn&#8217;t the case. As the pilot program progressed, the AI scanners &#8220;did not get any more accurate &#8212; there was not a single month where the alarm to visitor ratio fell below 25 percent,&#8221; Hell Gate reported.&nbsp;<\/p>\n<p><strong>Also: <a href=\"https:\/\/www.zdnet.com\/article\/ai-is-making-us-smarter-says-ai-pioneer-terry-sejnowski\/\">AI is making us smarter, says AI pioneer Terry Sejnowski<\/a><\/strong><\/p>\n<p><a href=\"https:\/\/hellgatenyc.com\/nyc-ai-weapons-scanners-pilot-false-positives\/\" target=\"_blank\" rel=\"noopener nofollow\" class=\"c-regularLink\">Additional reporting found<\/a>&nbsp;that the scanners had &#8220;a false positive rate of 95 percent,&#8221; and that only 0.45 percent of alerts were triggered by people carrying weapons who weren&#8217;t law enforcement.&nbsp;<\/p>\n<h2>What this means for school security&nbsp;<\/h2>\n<p>On Wednesday, Evolv Technologies&nbsp;<a href=\"https:\/\/ir.evolvtechnology.com\/news-events\/press-releases\/detail\/216\/evolv-announces-resolution-of-ftc-inquiry\" target=\"_blank\" rel=\"noopener nofollow\" class=\"c-regularLink\">reached an agreement<\/a>&nbsp;with the FTC to resolve the inquiry into its prior marketing claims. According to an FTC&nbsp;<a href=\"https:\/\/www.ftc.gov\/news-events\/news\/press-releases\/2024\/11\/ftc-takes-action-against-evolv-technologies-deceiving-users-about-its-ai-powered-security-screening\" target=\"_blank\" rel=\"noopener nofollow\" class=\"c-regularLink\">blog post<\/a>, the proposed settlement order would prevent Evolv from &#8220;making unsupported claims about its products&#8217; ability to detect weapons by using artificial intelligence.&#8221; It would also require Evolv to &#8220;notify certain K-12 school customers that they can opt to cancel contracts signed between April 1, 2022, to June 30, 2023,&#8221; which can be multi-year.&nbsp;<\/p>\n<p>Samuel Levine, Director of the Bureau of Consumer Protection, states in the blog that &#8220;The FTC has been clear that claims about technology &#8212; including artificial intelligence &#8212; need to be backed up, and that is especially important when these claims involve the safety of children.<strong>&#8220;<\/strong>&nbsp;<\/p>\n<p><strong>Also:&nbsp;<a href=\"https:\/\/www.zdnet.com\/article\/i-test-ai-tools-for-a-living-and-these-are-the-only-two-worth-paying-for\/\">I test AI tools for a living, and these are the only two worth paying for<\/a><\/strong><\/p>\n<p>Mike Ellenbogen, interim president and CEO of Evolv Technology, stated in the&nbsp;<a href=\"https:\/\/ir.evolvtechnology.com\/news-events\/press-releases\/detail\/216\/evolv-announces-resolution-of-ftc-inquiry\" target=\"_blank\" rel=\"noopener nofollow\" class=\"c-regularLink\">company&#8217;s press release<\/a>&nbsp;that the &#8220;FTC inquiry was about past marketing language and not our system&#8217;s ability to add value to security operations.&#8221; The company also pointed out &#8220;that the agency didn&#8217;t challenge the fundamental effectiveness of the company&#8217;s technology or require any monetary relief.&#8221;&nbsp;<\/p>\n<p>The proposed settlements also prohibit Evolv from making any false claims or misrepresentations about:<\/p>\n<ul>\n<li>&#8220;The ability of its products to detect weapons, ignore harmless personal items, and ignore harmless personal items without requiring visitors to remove any such items from pockets or bags&#8221;<\/li>\n<li>&#8220;Its products&#8217; accuracy in detecting weapons and false alarm rates, including in comparison to the use of traditional metal detectors&#8221;<\/li>\n<li>&#8220;The speed at which visitors can be screened compared to the use of metal detectors&#8221;<\/li>\n<li>&#8220;Labor costs, including comparisons to the use of metal detectors; testing, or the results of any testing; and any material aspect of its performance, including the use of algorithms, artificial intelligence, or other automated systems or tools.&#8221;<\/li>\n<\/ul>\n<p>The FTC has <a href=\"https:\/\/www.ftc.gov\/business-guidance\/blog\/2023\/02\/keep-your-ai-claims-check\" target=\"_blank\" rel=\"noopener nofollow\" class=\"c-regularLink\">noted in the past<\/a>&nbsp;that AI products can overpromise themselves as solutions for systemic issues, which is a consequence of&nbsp;<a href=\"https:\/\/www.zdnet.com\/article\/what-gartners-2024-hype-cycle-forecast-tells-us-about-the-future-of-ai-and-other-tech\/\">AI hype<\/a>.
