The lawsuit alleges that the university approved the lab&#8217;s refusal to deploy the anti-malware software &#8220;to satisfy the demands of the professor that headed the lab,&#8221; the DoJ said. This is claimed to have occurred between May 2019 and December 2021.<\/p>\n<div aria-hidden=\"true\" class=\"adun\" data-pos=\"top\" data-raptor=\"falcon\" data-xsm=\",fluid,mpu,\" data-sm=\",fluid,mpu,\" data-md=\",fluid,mpu,\"> <noscript> <a href=\"https:\/\/pubads.g.doubleclick.net\/gampad\/jump?co=1&amp;iu=\/6978\/reg_security\/front&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=4&amp;c=44Zs2IGPHQ9xLiUZEBlMCNpwAAAJY&amp;t=ct%3Dns%26unitnum%3D4%26raptor%3Dfalcon%26pos%3Dmid%26test%3D0\" target=\"_blank\" rel=\"noopener\"> <img decoding=\"async\" src=\"https:\/\/pubads.g.doubleclick.net\/gampad\/ad?co=1&amp;iu=\/6978\/reg_security\/front&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=4&amp;c=44Zs2IGPHQ9xLiUZEBlMCNpwAAAJY&amp;t=ct%3Dns%26unitnum%3D426raptor%3Dfalcon%26pos%3Dmid%26test%3D0\" alt> <\/a> <\/noscript> <\/div>\n<p>Refusing to install <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2024\/07\/02\/third_party_secutity\/\" rel=\"noopener\">anti-malware<\/a> solutions at a contractor like this is not allowed. In fact, it violates federal requirements and Georgia Tech&#8217;s own policies, but allegedly happened anyway.<\/p>\n<p>The university and the GTRC also, it is claimed, submitted a false cybersecurity assessment score in December 2020 \u2013 a requirement for all DoD contractors to demonstrate they&#8217;re meeting compliance standards.<\/p>\n<p>The two organizations are accused of issuing themselves a score of 98, which was later deemed to be fraudulent based on various factors.&nbsp;<\/p>\n<div aria-hidden=\"true\" class=\"adun\" id=\"story_eagle_xsm_sm_md_xmd_lg_xlg\" data-pos=\"mid\" data-raptor=\"eagle\" data-xsm=\",mpu,dmpu,\" data-sm=\",mpu,dmpu,\" data-md=\",mpu,dmpu,\" data-xmd=\",mpu,dmpu,\" data-lg=\",mpu,dmpu,\" data-xlg=\",mpu,dmpu,\"> <noscript> <a href=\"https:\/\/pubads.g.doubleclick.net\/gampad\/jump?co=1&amp;iu=\/6978\/reg_security\/front&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=3&amp;c=33Zs2IGPHQ9xLiUZEBlMCNpwAAAJY&amp;t=ct%3Dns%26unitnum%3D3%26raptor%3Deagle%26pos%3Dmid%26test%3D0\" target=\"_blank\" rel=\"noopener\"> <img decoding=\"async\" src=\"https:\/\/pubads.g.doubleclick.net\/gampad\/ad?co=1&amp;iu=\/6978\/reg_security\/front&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=3&amp;c=33Zs2IGPHQ9xLiUZEBlMCNpwAAAJY&amp;t=ct%3Dns%26unitnum%3D3%26raptor%3Deagle%26pos%3Dmid%26test%3D0\" alt> <\/a> <\/noscript> <\/div>\n<p>To summarize, the issue centers around the claim that the assessment was carried out on a &#8220;fictitious&#8221; environment, so on that basis the score wasn&#8217;t given to a system related to the DoD contract, the US alleges.<\/p>\n<p>The claims are being made under the False Claims Act (FCA), which is being utilized by the Civil Cyber-Fraud Initiative (CCFI), which was introduced in 2021 to punish entities that knowingly risk the safety of United States IT systems.<\/p>\n<p>It&#8217;s a first-of-its-kind case being pursued as part of the CCFI. All previous cases brought under the CCFI were settled before they reached the litigation stage.<\/p>\n<p>&#8220;Because the allegations suggest Georgia Tech falsely certified it was compliant with DoD contractual and regulatory requirements, they present a textbook case of potential FCA liability predicated on alleged non\u2010compliance with <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2024\/08\/14\/nist_postquantum_standards\/\" rel=\"noopener\">NIST standards<\/a>,&#8221; states an <a target=\"_blank\" href=\"https:\/\/www.omm.com\/insights\/alerts-publications\/doj-intervention-in-cybersecurity-suit-is-a-harbinger-of-cyber-fraud-initiative-s-focus-on-contractor-information-security-practices\/\" rel=\"nofollow noopener\">assessment of the case<\/a> from legal experts at O&#8217;Melveny.<\/p>\n<p>&#8220;The complaint contends personnel across teams at Georgia Tech interpreted NIST controls in a way that allowed them to designate whatever actions they were already taking to be &#8216;compliant&#8217; and implement interpretations that effectively rendered security controls meaningless.&#8221;<\/p>\n<p>The case was originally brought in July 2022 by Craig, who is still affiliated with Georgia Tech as the associate director of cybersecurity, and Koza, a Georgia Tech grad and former principal infosec engineer at GIT.<\/p>\n<p>The US filed and was swiftly granted a complaint-in-intervention in June 2024 after announcing its intent to join the lawsuit against Georgia Tech and GTRC in April.<\/p>\n<p>US officials expressed their displeasure with the defendants, saying they put national security and defense personnel at risk.<\/p>\n<p>&#8220;Deficiencies in cybersecurity controls pose a significant threat not only to our national security, but also to the safety of the men and women of our armed services that risk their lives daily,&#8221; <a target=\"_blank\" href=\"https:\/\/www.justice.gov\/usao-ndga\/pr\/united-states-files-suit-against-georgia-institute-technology-and-georgia-tech\" rel=\"nofollow noopener\">said<\/a> special agent-in-charge Darrin K Jones, Department of Defense Office of Inspector General, Defense Criminal Investigative Service (DCIS), Southeast Field Office.<\/p>\n<p>&#8220;As force multipliers, we place a substantial amount of trust in our contractors and expect them to meet the strict standards our service members deserve.&#8221;<\/p>\n<p>&#8220;Government contractors that fail to follow and fully implement required cybersecurity controls jeopardize the security of sensitive government information and information systems and create unnecessary risks to national security,&#8221; said principal deputy assistant attorney general Bryan Boynton of the Civil Division. &#8220;We will continue to pursue knowing cybersecurity-related violations under the Department&#8217;s Civil Cyber-Fraud Initiative.&#8221;<\/p>\n<p>Separately, Georgia Tech is also the subject of a Congressional probe into its potentially problematic relationship with China.<\/p>\n<p>Since 2013, the institution has partnered with Tianjin University, which is believed to have &#8220;significant ties&#8221; to the Chinese military and was previously blacklisted for <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2020\/09\/02\/chinese_prof_sentenced\/\" rel=\"noopener\">stealing American military technology<\/a>, and received &#8220;millions of dollars&#8221; from China to support this partnership.<\/p>\n<p>The partnership has borne fruit such as the <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2024\/01\/09\/first_functional_graphene_semiconductor_could\/\" rel=\"noopener\">first-ever graphene-based semiconductor<\/a>. Announced earlier this year, it&#8217;s thought that with some additional work, the material could surpass the performance of silicon.<\/p>\n<p>The investigation carried out by the House Select Committee on the Chinese Communist Party was only <a target=\"_blank\" href=\"https:\/\/selectcommitteeontheccp.house.gov\/media\/investigations\/investigation-georgia-tech-partnership-blacklisted-chinese-military-linked\" rel=\"nofollow noopener\">announced<\/a> in May this year, so it will take some time before we hear anything regarding its conclusion.<\/p>\n<p><em>The Reg<\/em> approached Georgia Tech and GTRC for a response.
