That is to say, all the claims against SolarWinds for what followed the 2019-2020 SUNBURST attack.<\/p>\n<p>SUNBURST is the code-name for some technologically top-notch <a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/cloud.google.com\/blog\/topics\/threat-intelligence\/sunburst-additional-technical-details\">backdoor malware<\/a> Russian spies <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2020\/12\/15\/solar_winds_update\/\" rel=\"noopener\">planted<\/a> in the IT network monitoring software suite Orion after the snoops gained access to SolarWinds&#8217; internal infrastructure.<\/p>\n<div aria-hidden=\"true\" class=\"adun\" data-pos=\"top\" data-raptor=\"condor\" data-xsm=\",fluid,mpu,\" data-sm=\",fluid,mpu,\" data-md=\",fluid,mpu,\"> <noscript> <a href=\"https:\/\/pubads.g.doubleclick.net\/gampad\/jump?co=1&amp;iu=\/6978\/reg_security\/cso&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=2&amp;c=2ZpmVscO02jbGoBJTxNcDYwAAAFQ&amp;t=ct%3Dns%26unitnum%3D2%26raptor%3Dcondor%26pos%3Dtop%26test%3D0\" target=\"_blank\" rel=\"noopener\"> <img decoding=\"async\" src=\"https:\/\/pubads.g.doubleclick.net\/gampad\/ad?co=1&amp;iu=\/6978\/reg_security\/cso&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=2&amp;c=2ZpmVscO02jbGoBJTxNcDYwAAAFQ&amp;t=ct%3Dns%26unitnum%3D2%26raptor%3Dcondor%26pos%3Dtop%26test%3D0\" alt> <\/a> <\/noscript> <\/div>\n<p>Orion is used by some 18,000 orgs including <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2020\/12\/18\/solarwinds_nnsa_microsoft_cisa\/\" rel=\"noopener\">Microsoft<\/a> and US government departments of State, Treasury, Homeland Security, and Commerce, making this a classic supply-chain attack. Following a motion by SolarWinds to have those allegations binned, Judge Engelmayer rejected those particular claims in his 107-page opinion.&nbsp;<\/p>\n<p>&#8220;These do not plausibly plead actionable deficiencies in the company&#8217;s reporting of the cybersecurity hack,&#8221; Engelmayer wrote. &#8220;They impermissibly rely on hindsight and speculation.&#8221;<\/p>\n<div aria-hidden=\"true\" class=\"adun\" data-pos=\"top\" data-raptor=\"falcon\" data-xsm=\",fluid,mpu,\" data-sm=\",fluid,mpu,\" data-md=\",fluid,mpu,\"> <noscript> <a href=\"https:\/\/pubads.g.doubleclick.net\/gampad\/jump?co=1&amp;iu=\/6978\/reg_security\/cso&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=4&amp;c=44ZpmVscO02jbGoBJTxNcDYwAAAFQ&amp;t=ct%3Dns%26unitnum%3D4%26raptor%3Dfalcon%26pos%3Dmid%26test%3D0\" target=\"_blank\" rel=\"noopener\"> <img decoding=\"async\" src=\"https:\/\/pubads.g.doubleclick.net\/gampad\/ad?co=1&amp;iu=\/6978\/reg_security\/cso&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=4&amp;c=44ZpmVscO02jbGoBJTxNcDYwAAAFQ&amp;t=ct%3Dns%26unitnum%3D426raptor%3Dfalcon%26pos%3Dmid%26test%3D0\" alt> <\/a> <\/noscript> <\/div>\n<p>The judge also tossed out the SEC&#8217;s claims relating to SolarWinds&#8217; internal accounting and disclosure controls and procedures.&nbsp;<\/p>\n<p>Engelmayer did, however, sustain the regulator&#8217;s claims of securities fraud based on SolarWinds&#8217; <em>pre<\/em>-SUNBURST statement about the security of its Orion product. Those allegations being:<\/p>\n<p>Other statements and filings made by SolarWinds supported the SEC&#8217;s claims regarding the developer&#8217;s &#8220;porous&#8221; security, the judge noted. These charges will proceed, and there&#8217;s no word on whether the SEC will appeal the ruling.<\/p>\n<p>A SEC spokesperson declined to comment on the judge&#8217;s opinion.&nbsp;SolarWinds, however, applauded the decision.<\/p>\n<p>&#8220;We are pleased that Judge Engelmeyer has largely granted our motion to dismiss the SEC&#8217;s claims,&#8221; a SolarWinds spokesperson told <em>The Register<\/em>. &#8220;We look forward to the next stage, where we will have the opportunity for the first time to present our own evidence and to demonstrate why the remaining claim is factually inaccurate.&#8221;<\/p>\n<p>The spokesperson also said the company is &#8220;grateful for the support we have received thus far across the industry, from our customers, from cybersecurity
