{"id":55858,"date":"2024-04-16T14:03:58","date_gmt":"2024-04-16T14:03:58","guid":{"rendered":"https:\/\/packetstormsecurity.com\/news\/view\/35788\/Google-Location-Tracking-Deal-Could-Be-Derailed-By-Politics.html"},"modified":"2024-04-16T14:03:58","modified_gmt":"2024-04-16T14:03:58","slug":"google-location-tracking-deal-could-be-derailed-by-politics","status":"publish","type":"post","link":"https:\/\/www.threatshub.org\/blog\/google-location-tracking-deal-could-be-derailed-by-politics\/","title":{"rendered":"Google Location Tracking Deal Could Be Derailed By Politics"},"content":{"rendered":"<p>Google&#8217;s plan to pay $62 million to settle allegations that it tracked people even when their Location History setting was switched off may have to be renegotiated based on several objections.<\/p>\n<p>These include an objection to the proposal on the grounds that there was a lack of payment to those affected, allegations of ties between Google and the nonprofit beneficiaries, and issues raised about the politics of those organizations.<\/p>\n<p>The <a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cand.330787\/gov.uscourts.cand.330787.327.0_2.pdf\">proposed settlement<\/a> [PDF], filed late last year, represents an attempt to resolve a <a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cand.330787\/gov.uscourts.cand.330787.1.0.pdf\">complaint<\/a> [PDF] filed back in August 2018 about Google tracking people&#8217;s locations through mobile applications, one of <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2023\/01\/03\/google_tracking_settlements\/\" rel=\"noopener\">many such cases<\/a> that collectively resulted in about $500 million in relief. \u2013&nbsp;to 21 nonprofit organizations, after $18 million is allocated to pay attorneys&#8217; fees and the small number of named plaintiffs receive $5,000 each.<\/p>\n<p>For example, the settlement proposal calls for the ACLU Speech, Privacy, and Technology Project and the Electronic Frontier Foundation to receive $6 million each, and for Georgetown Law, Harvard, MIT, and Yale to each receive $1.5 million, among other beneficiaries.<\/p>\n<div aria-hidden=\"true\" class=\"adun\" data-pos=\"top\" data-raptor=\"falcon\" data-xsm=\",fluid,mpu,\" data-sm=\",fluid,mpu,\" data-md=\",fluid,mpu,\"> <noscript> <a href=\"https:\/\/pubads.g.doubleclick.net\/gampad\/jump?co=1&amp;iu=\/6978\/reg_security\/front&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=4&amp;c=44Zh8RtqU6DwgczJ9O5aKDtAAAAM4&amp;t=ct%3Dns%26unitnum%3D4%26raptor%3Dfalcon%26pos%3Dmid%26test%3D0\" target=\"_blank\" rel=\"noopener\"> <img decoding=\"async\" src=\"https:\/\/pubads.g.doubleclick.net\/gampad\/ad?co=1&amp;iu=\/6978\/reg_security\/front&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=4&amp;c=44Zh8RtqU6DwgczJ9O5aKDtAAAAM4&amp;t=ct%3Dns%26unitnum%3D426raptor%3Dfalcon%26pos%3Dmid%26test%3D0\" alt> <\/a> <\/noscript> <\/div>\n<p>The idea is that paying these organizations represents the best practical remedy to Google&#8217;s behavior, because the groups support privacy through their education and policy work.<\/p>\n<p>Last month, however, and in a subsequent filing last week, attorney Theodore Frank, of the nonprofit Hamilton Lincoln Law Institute, urged the court to reject the settlement proposal, noting that it&#8217;s quite feasible to pay millions of plaintiffs.<\/p>\n<p>Frank has helped make that happen: He previously urged the rejection of a <em>cy pres<\/em> settlement in another Google privacy claim (<em>In Google Referrer Header Privacy Litigation<\/em>), and helped to get <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2023\/10\/25\/google_privacy_settlement\/\" rel=\"noopener\">$23 million directed to class members<\/a>. Given a 1.3 percent claim rate, that resulted in $7.70 being paid each to more than 2 million claims who would otherwise have gotten nothing.<\/p>\n<div aria-hidden=\"true\" class=\"adun\" id=\"story_eagle_xsm_sm_md_xmd_lg_xlg\" data-pos=\"mid\" data-raptor=\"eagle\" data-xsm=\",mpu,dmpu,\" data-sm=\",mpu,dmpu,\" data-md=\",mpu,dmpu,\" data-xmd=\",mpu,dmpu,\" data-lg=\",mpu,dmpu,\" data-xlg=\",mpu,dmpu,\"> <noscript> <a href=\"https:\/\/pubads.g.doubleclick.net\/gampad\/jump?co=1&amp;iu=\/6978\/reg_security\/front&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=3&amp;c=33Zh8RtqU6DwgczJ9O5aKDtAAAAM4&amp;t=ct%3Dns%26unitnum%3D3%26raptor%3Deagle%26pos%3Dmid%26test%3D0\" target=\"_blank\" rel=\"noopener\"> <img decoding=\"async\" src=\"https:\/\/pubads.g.doubleclick.net\/gampad\/ad?co=1&amp;iu=\/6978\/reg_security\/front&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=3&amp;c=33Zh8RtqU6DwgczJ9O5aKDtAAAAM4&amp;t=ct%3Dns%26unitnum%3D3%26raptor%3Deagle%26pos%3Dmid%26test%3D0\" alt> <\/a> <\/noscript> <\/div>\n<p>With regard to the Location History case, Frank argued in <a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cand.330787\/gov.uscourts.cand.330787.357.0.pdf\">a filing<\/a> [PDF] last week that the organizations receiving the money &#8220;engage in work that a substantial percentage of the class would not want to support (such as &#8216;racial justice&#8217; \u2013 a codeword for support for racial discrimination and anti-Semitic policies \u2013 and promoting abortion).&#8221;<\/p>\n<p>Essentially, he&#8217;s arguing that those in the settlement Class with conservative views are not being represented adequately if the funds go to organizations that support progressive causes.<\/p>\n<p>He also objects that some of these organizations focus only on a narrow subset of people affected by Google&#8217;s tracking, &#8220;(e.g., computer science undergraduates or &#8216;historically marginalized communities&#8217;).&#8221;<\/p>\n<p>What&#8217;s more, Frank contends that many of the organizations that would benefit from Google&#8217;s funds have prior relationships that raises questions about conflict of interest.<\/p>\n<p>&#8220;Multiple attorneys from the law firms litigating the case sit on the boards of the proposed recipients,&#8221; he asserts in a March <a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cand.330787\/gov.uscourts.cand.330787.354.0.pdf\">filing<\/a> [PDF]. He also points out that the lead law firm handling the case, Lieff Cabraser Heimann &amp; Bernstein, LLP, has worked with the two proposed settlement recipients, the Electronic Frontier Foundation and the American Civil Liberties Union.<\/p>\n<p>What&#8217;s more, he contends, because Google already gives to several of the designated <em>cy pres<\/em> organizations, the value of the settlement is less than it appears: &#8220;this is merely a shift in accounting entries, with no evidence that the <em>cy pres<\/em> is not displacing donations Google would already make.&#8221;<\/p>\n<p>&#8220;The fundamental problem is that the money belongs to the class, which has not consented to have $40-$50 million of its money given away to friends of the plaintiffs\u2019 lawyers and often ideological organizations,&#8221; Frank told <em>The Register<\/em> in an email.<\/p>\n<p>&#8220;If a lawyer is representing an odious billionaire (call him Monty Burns) and decides to divert a few million dollars of his client&#8217;s money to a nonprofit because the lawyer feels the nonprofit will spend it better than the billionaire would, the lawyer would go to jail for embezzlement and be disbarred. There shouldn&#8217;t be an exception just because the clients here aren\u2019t billionaires.&#8221;<\/p>\n<p>The plaintiffs pursuing the settlement have been allowed to file a response but have not yet done so.<\/p>\n<p>A hearing on the objection to the proposed settlement is scheduled for Thursday, April 18, 2024. \u00ae<\/p>\n<p> READ MORE <a
