{"id":55482,"date":"2024-03-01T22:15:59","date_gmt":"2024-03-01T22:15:59","guid":{"rendered":"https:\/\/www.threatshub.org\/blog\/judge-orders-nso-to-cough-up-pegasus-super-spyware-source-code\/"},"modified":"2024-03-01T22:15:59","modified_gmt":"2024-03-01T22:15:59","slug":"judge-orders-nso-to-cough-up-pegasus-super-spyware-source-code","status":"publish","type":"post","link":"https:\/\/www.threatshub.org\/blog\/judge-orders-nso-to-cough-up-pegasus-super-spyware-source-code\/","title":{"rendered":"Judge orders NSO to cough up Pegasus super-spyware source code"},"content":{"rendered":"<p>NSO Group, the Israel-based maker of super-charged snoopware Pegasus, has been ordered by a federal judge in California to share the source code for &#8220;all relevant spyware&#8221; with Meta&#8217;s WhatsApp.<\/p>\n<p>The <a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cand.350613\/gov.uscourts.cand.350613.292.0.pdf\">order<\/a> [PDF] from Judge Phyllis Hamilton at the end of last month stems from WhatsApp&#8217;s <a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cand.350613\/gov.uscourts.cand.350613.1.0_3.pdf\">2019 lawsuit<\/a> [PDF] against NSO for allegedly spying on 1,400 WhatsApp users.<\/p>\n<p>The spyware maker is accused of sending carefully crafted data over the internet to select people&#8217;s phones that, via a vulnerability in the chat app&#8217;s VoIP stack, allowed malicious code to silently run on those devices, code that in turn allowed victims&#8217; conversations and other sensitive information to be accessed remotely. Similarly, its effort to have Apple&#8217;s lawsuit tossed <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2024\/01\/24\/us_judge_rejects_pegasus_spyware\/\" rel=\"noopener\">was rejected<\/a> in January by a federal judge.<\/p>\n<div aria-hidden=\"true\" class=\"adun\" id=\"story_eagle_xsm_sm_md_xmd_lg_xlg\" data-pos=\"mid\" data-raptor=\"eagle\" data-xsm=\",mpu,dmpu,\" data-sm=\",mpu,dmpu,\" data-md=\",mpu,dmpu,\" data-xmd=\",mpu,dmpu,\" data-lg=\",mpu,dmpu,\" data-xlg=\",mpu,dmpu,\"> <noscript> <a href=\"https:\/\/pubads.g.doubleclick.net\/gampad\/jump?co=1&amp;iu=\/6978\/reg_security\/front&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=3&amp;c=33ZeN6J0iiqokE3NB8OBzOYwAAAlQ&amp;t=ct%3Dns%26unitnum%3D3%26raptor%3Deagle%26pos%3Dmid%26test%3D0\" target=\"_blank\" rel=\"noopener\"> <img decoding=\"async\" src=\"https:\/\/pubads.g.doubleclick.net\/gampad\/ad?co=1&amp;iu=\/6978\/reg_security\/front&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=3&amp;c=33ZeN6J0iiqokE3NB8OBzOYwAAAlQ&amp;t=ct%3Dns%26unitnum%3D3%26raptor%3Deagle%26pos%3Dmid%26test%3D0\" alt> <\/a> <\/noscript> <\/div>\n<p>Since WhatsApp filed its lawsuit in 2019, pressure has been mounting to curtail the sale of sophisticated spyware. The US has <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2023\/07\/18\/us_sanctions_commercial_spyware\/\" rel=\"noopener\">sanctioned<\/a> commercial spyware vendors like NSO Group, Intellexa, and Cytrox. And the White House <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2023\/03\/28\/biden_spyware_executive_order\/\" rel=\"noopener\">issued an executive order<\/a> last year that somewhat banned government use of spyware \u2013 exceptions leave leeway for US snoops and homegrown surveillance software.<\/p>\n<p>Governments elsewhere, like Poland and Spain, have been conducting inquiries into the alleged use of Pegasus spyware against political figures and journalists. Nonetheless, the commercial spyware business <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2024\/02\/07\/spyware_business_booming\/\" rel=\"noopener\">appears to be<\/a> doing just fine. As with encryption, governments want spyware for themselves but not for others.<\/p>\n<p>NSO Group has maintained that it only sells spyware to government customers for notionally lawful surveillance. &#8220;Our technology is not designed or licensed for use against human rights activists and journalists,&#8221; the outfit told <em>The Register<\/em> in 2019. &#8220;It has helped to save thousands of lives over recent years.&#8221;<\/p>\n<p><em>The Register<\/em> is unaware of which lives, if any, have been saved by Pegasus. However, Amnesty International contends that the software, among other harms, played a role in an infamous assassination. It <a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/www.amnesty.org\/en\/latest\/news\/2021\/07\/the-pegasus-project-2\/\">notes<\/a> that &#8220;family members of Saudi journalist Jamal Khashoggi were targeted with Pegasus software before and after his murder in Istanbul on 2 October 2018 by Saudi operatives, despite repeated denials from NSO Group.&#8221; Other media reports have <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2021\/03\/01\/in_brief_security\/\" rel=\"noopener\">indicated<\/a> as much.<\/p>\n<blockquote class=\"pullquote\" Amnesty International, hailed the court order as a step toward accountability but expressed disappointment that NSO won&#8217;t have to reveal the clients responsible for the allegedly unlawful targeting of WhatApp users.<\/p>\n<p>&#8220;NSO Group says that it only sells Pegasus to authorized government customers,&#8221; \u00d3 Cearbhaill told <em>The Register<\/em>. &#8220;Our Security Lab has documented the massive scale and breadth of the use of Pegasus against human rights defenders and journalists across the world.<\/p>\n<p>&#8220;It is vital that targets of Pegasus find out who has purchased and deployed the spyware against them so that they can seek meaningful redress.&#8221;<\/p>\n<p>A WhatsApp spokesperson welcomed Judge Hamilton&#8217;s decision. \u201cThe recent court ruling is an important milestone in our long running goal of protecting WhatsApp users against unlawful attacks,\u201d a spokesperson told <em>The Register<\/em> via email.<\/p>\n<p>\u201cSpyware
