more than 30 civil and digital rights organizations said yesterday in a letter backing new privacy laws in the city.<\/p>\n<p>The New York Civil Liberties Union, the Surveillance Technology Oversight Project, Amnesty International and others wrote a memo of support for two pending state bills (1014-2023 and 1024-2023) that aim to ban facial recognition and other biometric tech both in public spaces, such as shops and arenas, and in residential buildings.<\/p>\n<p>In the letter [<a target=\"_blank\" href=\"https:\/\/static1.squarespace.com\/static\/5c1bfc7eee175995a4ceb638\/t\/6511dda3f2cbb63c82f6f37d\/1695669668227\/Ints.+1014+and+1024+Memo+of+Support_9_26_2023+Updated.pdf\" rel=\"noopener\">PDF<\/a>], the groups say the City Council is &#8220;long overdue in taking action&#8221; biometric data.&#8221;<\/p>\n<p>The second, 1024-2023, focuses on the use of facial recog and other biometric surveillance in &#8220;residential settings.&#8221; The groups claim that &#8220;landlords will abuse this tech to justify evicting tenants from rent-stabilized units because the facial recognition technology system determines they were not at home often enough.&#8221; They add: &#8220;In fact, vendors have already begun to advertise this technology. In public housing, its use has led to residents being evicted for minor violations of policy.&#8221;<\/p>\n<div aria-hidden=\"true\" class=\"adun\" data-pos=\"top\" data-raptor=\"falcon\" data-xsm=\",fluid,mpu,\" data-sm=\",fluid,mpu,\" data-md=\",fluid,mpu,\"> <noscript> <a href=\"https:\/\/pubads.g.doubleclick.net\/gampad\/jump?co=1&amp;iu=\/6978\/reg_security\/front&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=4&amp;c=44ZRTJrTfYDDzIh1msukIlLQAAAA0&amp;t=ct%3Dns%26unitnum%3D4%26raptor%3Dfalcon%26pos%3Dmid%26test%3D0\" target=\"_blank\" rel=\"noopener\"> <img decoding=\"async\" src=\"https:\/\/pubads.g.doubleclick.net\/gampad\/ad?co=1&amp;iu=\/6978\/reg_security\/front&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=4&amp;c=44ZRTJrTfYDDzIh1msukIlLQAAAA0&amp;t=ct%3Dns%26unitnum%3D426raptor%3Dfalcon%26pos%3Dmid%26test%3D0\" alt> <\/a> <\/noscript> <\/div>\n<p>The orgs went on to cite the example of a single mother who &#8220;was targeted after she started night classes and asked her ex-husband to spend more time at her home watching their children, causing her to be flagged for potentially violating the housing authority&#8217;s visitor policy.&#8221;<\/p>\n<div class=\"promo_article\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/regmedia.co.uk\/2019\/02\/27\/shutterstock_facial_recog_csrowds.jpg?x=174&amp;amp;y=115&amp;amp;crop=1\" width=\"174\" height=\"115\" alt=\"facial recog cameras \"><\/p>\n<h2 title=\"Question not whether UK police should use facial recog, but how, says surveillance chief\">UK&#8217;s GDPR replacement could wipe out oversight of live facial recognition<\/h2>\n<p><a href=\"https:\/\/www.theregister.com\/2023\/05\/19\/dpib_2_surveillance_oversight\/\"><span>READ MORE<\/span><\/a><\/div>\n<p>The bills have come under particular attention after an <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2022\/12\/21\/rockettes_facial_recognition_msg\/\" rel=\"noopener\">incident in December<\/a> where lawyer Kelly Conlon got turned away at the door of Radio City Music Hall after a facial recognition system pinned her as a &#8220;prohibited person.&#8221; Conlon was there as a chaperone for a Girl Scout troop trip to see the Rockettes. The reason she&#8217;d been marked as persona non grata by the face-matching cams, it soon emerged, was because the New Jersey law firm she worked for \u2013 Davis, Saperstein and Solomon \u2013 had been involved in years-long personal injury litigation against a restaurant now owned by Madison Square Garden Entertainment, which operates the venue. Creepily, Conlon told a local NBC outlet: &#8220;They knew my name before I told them.&#8221;<\/p>\n<p>MSG Entertainment, though, said Conlon&#8217;s firm had been warned about its &#8220;policy&#8221; and that use of facial recognition was &#8220;clearly advertised to guests&#8221; \u2013 hopefully before they show up at the venue.<\/p>\n<p>While obviously in Conlon&#8217;s case it was effective, facial recognition critics say the tech is often highly inaccurate. Research on inherent biases in the system <a target=\"_blank\" href=\"http:\/\/ieeexplore.ieee.org\/document\/6327355\/\" rel=\"nofollow noopener\">has previously shown<\/a> that matching accuracies are lower on women and people of color and Amnesty International has <a target=\"_blank\" href=\"https:\/\/www.law.umich.edu\/special\/exoneration\/Documents\/Race_and_Wrongful_Convictions.pdf\" rel=\"noopener\">said<\/a> that in a criminal justice setting, face recognition technologies that are &#8220;inherently biased in their accuracy can misidentify suspects, incarcerating innocent Black Americans&#8221; [PDF].<\/p>\n<p>Meanwhile, some facial recog business have fallen afoul of the law. Clearview AI, for example, had to promise not to sell facial recognition databases to most US businesses after settling a lawsuit with the ACLU last year. The outfit famously scrapes images from Facebook and the like to build its facial ID database.<\/p>\n<p>Over in the UK, meanwhile, Clearview was <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2022\/05\/23\/clearview_ai_ico_fine\/\" rel=\"noopener\">fined millions<\/a> by the Information Commissioner (ICO) for scraping the web for face data. The privacy watchdog said there was no &#8220;lawful reason&#8221; to collect Brits&#8217; images while Clearview has said in its defense that the data subjects are making these images publicly available themselves.<\/p>\n<div aria-hidden=\"true\" class=\"adun\" id=\"story_eagle_xsm_sm_md_xmd_lg_xlg\" data-pos=\"mid\" data-raptor=\"eagle\" data-xsm=\",mpu,dmpu,\" data-sm=\",mpu,dmpu,\" data-md=\",mpu,dmpu,\" data-xmd=\",mpu,dmpu,\" data-lg=\",mpu,dmpu,\" data-xlg=\",mpu,dmpu,\"> <noscript> <a href=\"https:\/\/pubads.g.doubleclick.net\/gampad\/jump?co=1&amp;iu=\/6978\/reg_security\/front&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=3&amp;c=33ZRTJrTfYDDzIh1msukIlLQAAAA0&amp;t=ct%3Dns%26unitnum%3D3%26raptor%3Deagle%26pos%3Dmid%26test%3D0\" target=\"_blank\" rel=\"noopener\"> <img decoding=\"async\" src=\"https:\/\/pubads.g.doubleclick.net\/gampad\/ad?co=1&amp;iu=\/6978\/reg_security\/front&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=3&amp;c=33ZRTJrTfYDDzIh1msukIlLQAAAA0&amp;t=ct%3Dns%26unitnum%3D3%26raptor%3Deagle%26pos%3Dmid%26test%3D0\" alt> <\/a> <\/noscript> <\/div>\n<p>However, the ICO has been less explicit about how it intends to regulate the field from now on as the latest UK government tries to overhaul EU-era law. UK Biometrics and Surveillance Camera Commissioner, Professor Fraser Sampson, <a target=\"_blank\" href=\"https:\/\/assets.publishing.service.gov.uk\/government\/uploads\/system\/uploads\/attachment_data\/file\/1184611\/BSCC_response_-_ICO_biometric_data_guidance_consultation.pdf\" rel=\"noopener\">said<\/a> [PDF] earlier this month that an ICO consultation on the draft biometric data guidance had some large gaps.<\/p>\n<p>Sampson told us earlier this year that the UK&#8217;s would-be GDPR replacement the DPDI bill (now on take 2) \u2013 could wipe out oversight of live facial recognition with the abolishment of his role despite recent police moves to &#8220;embed&#8221; facial recog into the country&#8217;s police force.<\/p>\n<p>Under the upcoming <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2023\/06\/15\/european_parliament_ai_act\/\" rel=\"noopener\">AI Act<\/a>, the European Union adopted a draft text earlier this year that includes a complete ban on the use of AI for biometric surveillance, emotion recognition, and predictive
