In the UK, similar legislation, <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2023\/02\/25\/signal_uk_online_safety_bill\/\" rel=\"noopener\">the Online Safety Bill<\/a>, is being considered.<\/p>\n<div aria-hidden=\"true\" class=\"adun\" data-pos=\"top\" data-raptor=\"falcon\" data-xsm=\",fluid,mpu,\" data-sm=\",fluid,mpu,\" data-md=\",fluid,mpu,\"> <noscript> <a href=\"https:\/\/pubads.g.doubleclick.net\/gampad\/jump?co=1&amp;iu=\/6978\/reg_security\/front&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=4&amp;c=44ZAZcCxl5oRy6vLPM@ZqiqgAAAAc&amp;t=ct%3Dns%26unitnum%3D4%26raptor%3Dfalcon%26pos%3Dmid%26test%3D0\" target=\"_blank\" rel=\"noopener\"> <img decoding=\"async\" src=\"https:\/\/pubads.g.doubleclick.net\/gampad\/ad?co=1&amp;iu=\/6978\/reg_security\/front&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=4&amp;c=44ZAZcCxl5oRy6vLPM@ZqiqgAAAAc&amp;t=ct%3Dns%26unitnum%3D426raptor%3Dfalcon%26pos%3Dmid%26test%3D0\" alt> <\/a> <\/noscript> <\/div>\n<p>Chat Control 2.0 scanning would also be applied to cloud storage services. In addition, the proposed law calls for age restrictions on communications and storage apps, and in app stores, to prevent minors from accessing apps that could convey harmful content. It would cover all commercial services, regardless of size, exempting non-commercial services that are not ad-funded (e.g., many open source projects).<\/p>\n<p>The EU plan has been vigorously opposed <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2022\/10\/13\/clientside_scanning_csam_anderson\/\" rel=\"noopener\">by academics<\/a>, <a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/freiheitsrechte.org\/en\/themen\/digitale-grundrechte\/chatkontrolle\">rights groups<\/a>, and privacy-focused technology vendors like Tutanota, which <a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/tutanota.com\/blog\/posts\/germany-against-client-side-scanning-csam\">noted the opposition to Chat Control 2.0<\/a> in Germany&#8217;s Digital Affairs Committee hearing.<\/p>\n<p>Policy and technical experts at the hearing like Felix Reda from the Society for Civil Rights challenged the proposal for the damage it would do to privacy rights.<\/p>\n<div aria-hidden=\"true\" class=\"adun\" id=\"story_eagle_xsm_sm_md_xmd_lg_xlg\" data-pos=\"mid\" data-raptor=\"eagle\" data-xsm=\",mpu,dmpu,\" data-sm=\",mpu,dmpu,\" data-md=\",mpu,dmpu,\" data-xmd=\",mpu,dmpu,\" data-lg=\",mpu,dmpu,\" data-xlg=\",mpu,dmpu,\"> <noscript> <a href=\"https:\/\/pubads.g.doubleclick.net\/gampad\/jump?co=1&amp;iu=\/6978\/reg_security\/front&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=3&amp;c=33ZAZcCxl5oRy6vLPM@ZqiqgAAAAc&amp;t=ct%3Dns%26unitnum%3D3%26raptor%3Deagle%26pos%3Dmid%26test%3D0\" target=\"_blank\" rel=\"noopener\"> <img decoding=\"async\" src=\"https:\/\/pubads.g.doubleclick.net\/gampad\/ad?co=1&amp;iu=\/6978\/reg_security\/front&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=3&amp;c=33ZAZcCxl5oRy6vLPM@ZqiqgAAAAc&amp;t=ct%3Dns%26unitnum%3D3%26raptor%3Deagle%26pos%3Dmid%26test%3D0\" alt> <\/a> <\/noscript> <\/div>\n<p>Ella Jakubowska, policy advisor at European Digital Rights, <a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/www.bundestag.de\/resource\/blob\/935812\/140b3c04f7e77840f01a0d3d7dfda1fc\/Stellungnahme-Jakubowska-data.pdf\">said<\/a> [PDF] the scanning proposal would likely violate the EU Charter of Fundamental Rights, the Digital Services Act (DSA), and the General Data Protection Regulation (GDPR), among other laws.<\/p>\n<p>Elina Eickst\u00e4dt, computer scientist and representative of The Chaos Computer Club, warned [<a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/www.bundestag.de\/resource\/blob\/935528\/05e852168f6e6ff4e81a2c5cb1d1e9a1\/Stellungnahme-Eickstaedt-data.pdf\">PDF<\/a>, German] that the capabilities of scanning technology are being overestimated and that the technology would produce a huge number of false positives, something police in The Netherlands already consider a burden under the current reporting system.<\/p>\n<p>The challenge of dealing with false positives was also cited by professor Martin Steinebach from the Fraunhofer Institute for Secure Information Technology.<\/p>\n<p>Markus Hartmann, senior public prosecutor for cybercrime in the North Rhine-Westphalia region of Germany, said that encryption can pose an obstacle to investigators. &#8220;Nonetheless, end-to-end encryption of perpetrator communication in the crime area of online child abuse considered here proves to be a thorough investigation obstacle only in a clearly insignificant number of cases,&#8221; he <a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/www.bundestag.de\/resource\/blob\/935242\/19b6e52b37f70280cbaa938acc50d43d\/Stellungnahme-Hartmann-data.pdf\">said<\/a>, as algorithmically translated.<\/p>\n<p>The main obstacle to prosecuting criminal offenses, he said, is not encryption but &#8220;insufficient technical and human resources in the law enforcement agencies.&#8221;<\/p>\n<p>Breyer, in response to the German hearing, <a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/www.patrick-breyer.de\/en\/chat-control-child-sexual-abuse-regulation-expert-hearing-warnings-from-all-sides\/\">said<\/a>, &#8220;With Chat Control [2.0], the EU is planning a mass surveillance system that is so extreme that it exists nowhere else in the free world. The only country that practices such indiscriminate searches is authoritarian China.&#8221;<\/p>\n<p>According to Tutanota, there&#8217;s resistance to the proposal in Austria, Germany, Ireland, and the Netherlands.
