After the lower courts rejected its argument, NSO appealed to the US Supreme Court, which today denied [<a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/www.supremecourt.gov\/orders\/courtorders\/010923zor_p860.pdf\">PDF<\/a>] its case, thus kicking it back to the Court of Appeals.<\/p>\n<p>NSO, for its part, maintains that Pegasus&#8217; use was \u2014&nbsp;and is \u2014 all aboveboard.<\/p>\n<div aria-hidden=\"true\" class=\"adun\" data-pos=\"top\" data-raptor=\"falcon\" data-xsm=\",fluid,mpu,\" data-sm=\",fluid,mpu,\" data-md=\",fluid,mpu,\"> <noscript> <a href=\"https:\/\/pubads.g.doubleclick.net\/gampad\/jump?co=1&amp;iu=\/6978\/reg_security\/front&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=4&amp;c=44Y7y0qOn5hepAn-aoctzquQAAAA4&amp;t=ct%3Dns%26unitnum%3D4%26raptor%3Dfalcon%26pos%3Dmid%26test%3D0\" target=\"_blank\" rel=\"noopener\"> <img decoding=\"async\" src=\"https:\/\/pubads.g.doubleclick.net\/gampad\/ad?co=1&amp;iu=\/6978\/reg_security\/front&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=4&amp;c=44Y7y0qOn5hepAn-aoctzquQAAAA4&amp;t=ct%3Dns%26unitnum%3D426raptor%3Dfalcon%26pos%3Dmid%26test%3D0\" alt> <\/a> <\/noscript> <\/div>\n<p>&#8220;Meta has repeatedly impeded law enforcement&#8217;s ability to lawfully investigate criminals&#8217; use of WhatsApp to commit serious crimes and acts of terror,&#8221; an NSO spokesperson told <em>The Register<\/em>. &#8220;We are confident that the court will determine that the use of Pegasus by its customers was legal.&#8221;<\/p>\n<p>Previously, the US Solicitor General filed an amicus brief [<a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/21\/21-1338\/247116\/20221121154250394_NSO%20v.%20WhatsAppp%20CVSG.pdf\">PDF<\/a>] advising the Supreme Court not to hear the spyware developer&#8217;s case, noting &#8220;NSO plainly is not entitled to immunity here.&#8221;<\/p>\n<p>The high court&#8217;s decision paves the way for future lawsuits brought by journalists and others illegally targeted by spyware, <a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/knightcolumbia.org\/content\/knight-institute-comments-on-supreme-courts-denial-of-cert-in-nso-v-whatsapp\">said<\/a> Carrie DeCell, senior staff attorney at the Knight First Amendment Institute at Columbia University.<\/p>\n<div aria-hidden=\"true\" class=\"adun\" id=\"story_eagle_xsm_sm_md_xmd_lg_xlg\" data-pos=\"mid\" data-raptor=\"eagle\" data-xsm=\",mpu,dmpu,\" data-sm=\",mpu,dmpu,\" data-md=\",mpu,dmpu,\" data-xmd=\",mpu,dmpu,\" data-lg=\",mpu,dmpu,\" data-xlg=\",mpu,dmpu,\"> <noscript> <a href=\"https:\/\/pubads.g.doubleclick.net\/gampad\/jump?co=1&amp;iu=\/6978\/reg_security\/front&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=3&amp;c=33Y7y0qOn5hepAn-aoctzquQAAAA4&amp;t=ct%3Dns%26unitnum%3D3%26raptor%3Deagle%26pos%3Dmid%26test%3D0\" target=\"_blank\" rel=\"noopener\"> <img decoding=\"async\" src=\"https:\/\/pubads.g.doubleclick.net\/gampad\/ad?co=1&amp;iu=\/6978\/reg_security\/front&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=3&amp;c=33Y7y0qOn5hepAn-aoctzquQAAAA4&amp;t=ct%3Dns%26unitnum%3D3%26raptor%3Deagle%26pos%3Dmid%26test%3D0\" alt> <\/a> <\/noscript> <\/div>\n<p>&#8220;Today&#8217;s decision clears the path for lawsuits brought by the tech companies, as well as for suits brought by journalists and human rights advocates who have been victims of spyware attacks. The use of spyware to surveil and intimidate journalists poses one of the most urgent threats to press freedom and democracy today.&#8221;<\/p>\n<p>Late last year, the Knight Institute <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2022\/12\/01\/google_heliconia_spyware\/\" rel=\"noopener\">filed a lawsuit<\/a> against NSO on behalf of journalists and other members of the leading Central American news organization El Faro \u2014 the first such lawsuit filed by journalists against NSO in a US court.<\/p>\n<p>The complaint alleges that NSO Group and its parent company, Q Cyber Technologies, violated US laws by helping to deploy Pegasus spyware to remotely access journalists&#8217; iPhones.<\/p>\n<p>In addition to the lawsuits, NSO and other spyware makers also face <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2022\/07\/27\/us_congress_spyware_debate\/\" rel=\"noopener\">increased enforcement in the US<\/a> and <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2022\/06\/24\/nso_customers_eu_pegasus\/\" rel=\"noopener\">Europe<\/a> as lawmakers.<\/p>\n<p>Over the summer, the embattled software developer <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2022\/08\/22\/nso_group_ceo_steps_down\/\" rel=\"noopener\">announced a reorganization<\/a> in which it replaced its CEO and axed about 100
