NSO makes snoopware for Android as well as iOS, Apple was keen to remind us.<\/p>\n<blockquote class=\"pullquote\" readability=\"7\">\n<p>In a free society, it is unacceptable to weaponize powerful state-sponsored spyware against those who seek to make the world a better place<\/p>\n<\/blockquote>\n<p>&#8220;The steps we\u2019re taking today will send a clear message: in a free society, it is unacceptable to weaponize powerful state-sponsored spyware against those who seek to make the world a better place,\u201d said Ivan Krsti\u0107, head of Apple Security Engineering and Architecture, in <a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/www.apple.com\/newsroom\/2021\/11\/apple-sues-nso-group-to-curb-the-abuse-of-state-sponsored-spyware\/\">a statement<\/a>. \u201cWe will continue to work tirelessly to protect our users from abusive state-sponsored actors like NSO Group.\u201d<\/p>\n<p>Apple cited <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2021\/11\/03\/us_sanctions_spyware\/\" rel=\"noopener\">this month&#8217;s sanctioning<\/a> of four spyware vendors, including NSO, by the US Department of Commerce, as well as other <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2021\/10\/20\/us_intrusion_software_rules\/\" rel=\"noopener\">crackdowns<\/a> by Uncle Sam, to support its position that Pegasus is used to commit human-rights abuses.<\/p>\n<p>Apple argued that though NSO sells Pegasus to foreign governments and others, the developer is heavily involved in each deployment of the tracking software, and thus needs to be held responsible for the ultimate use of the code. What typically happens is that a booby-trapped message is sent to a selected target&#8217;s device, or they are invited to open a specially crafted file, which triggers the silent and hidden installation of Pegasus. At that point, the spyware can be instructed to quietly exfiltrate data.<\/p>\n<div aria-hidden=\"true\" class=\"adun\" data-pos=\"top\" data-raptor=\"falcon\" data-xsm=\",fluid,mpu,\" data-sm=\",fluid,mpu,\" data-md=\",fluid,mpu,\"> <noscript> <a href=\"https:\/\/pubads.g.doubleclick.net\/gampad\/jump?co=1&amp;iu=\/6978\/reg_security\/front&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=4&amp;c=44YZ-iT-VXd73Fjj0Fjyc50QAAANg&amp;t=ct%3Dns%26unitnum%3D4%26raptor%3Dfalcon%26pos%3Dmid%26test%3D0\" target=\"_blank\" rel=\"noopener\"> <img decoding=\"async\" src=\"https:\/\/pubads.g.doubleclick.net\/gampad\/ad?co=1&amp;iu=\/6978\/reg_security\/front&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=4&amp;c=44YZ-iT-VXd73Fjj0Fjyc50QAAANg&amp;t=ct%3Dns%26unitnum%3D426raptor%3Dfalcon%26pos%3Dmid%26test%3D0\" alt> <\/a> <\/noscript> <\/div>\n<p>And on that note, the iTitan discussed how Pegasus was able to earlier this year get onto a few Apple iPhones without any user interaction, and why the biz rushed out <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2021\/10\/12\/apple_ios_15_0_2_zero_day_patched\/\" rel=\"noopener\">an emergency patch<\/a> in September to thwart these deployments.<\/p>\n<p>Between February and September, NSO used a zero-click technique to infect selected iOS devices, Cupertino claimed. The exploit, dubbed FORCEDENTRY by its discoverers at Canadian non-profit Citizen Lab, was able to get around security protections in iOS and automatically install Pegasus.<\/p>\n<p>&#8220;Apple is notifying the small number of users that it discovered may have been targeted by FORCEDENTRY,&#8221; the iBiz added. &#8220;Any time Apple discovers activity consistent with a state-sponsored spyware attack, Apple will notify the affected users in accordance with industry best practices.&#8221;<\/p>\n<p>Apple said NSO operatives set up 100 Apple ID accounts that were used to send &#8220;abusive data&#8221; \u2013 likely messages with a malicious code payload \u2013 to their selected victims. These communications disabled iOS logging procedures, we&#8217;re told, and installed Pegasus with no user interaction at all; one message inbound and you&#8217;re pwned.<\/p>\n<p>While this is a clear violation of the US Computer Fraud and Abuse Act, Apple alleged, it&#8217;s also a violation of the iGiant&#8217;s own terms and conditions, and amounts to breach of contract or unjust enrichment, since by signing up for the Apple accounts NSO&#8217;s goons agreed to abide by Apple&#8217;s T&amp;Cs.<\/p>\n<div aria-hidden=\"true\" class=\"adun\" id=\"story_eagle_xsm_sm_md_xmd_lg_xlg\" data-pos=\"mid\" data-raptor=\"eagle\" data-xsm=\",mpu,dmpu,\" data-sm=\",mpu,dmpu,\" data-md=\",mpu,dmpu,\" data-xmd=\",mpu,dmpu,\" data-lg=\",mpu,dmpu,\" data-xlg=\",mpu,dmpu,\"> <noscript> <a href=\"https:\/\/pubads.g.doubleclick.net\/gampad\/jump?co=1&amp;iu=\/6978\/reg_security\/front&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=3&amp;c=33YZ-iT-VXd73Fjj0Fjyc50QAAANg&amp;t=ct%3Dns%26unitnum%3D3%26raptor%3Deagle%26pos%3Dmid%26test%3D0\" target=\"_blank\" rel=\"noopener\"> <img decoding=\"async\" src=\"https:\/\/pubads.g.doubleclick.net\/gampad\/ad?co=1&amp;iu=\/6978\/reg_security\/front&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=3&amp;c=33YZ-iT-VXd73Fjj0Fjyc50QAAANg&amp;t=ct%3Dns%26unitnum%3D3%26raptor%3Deagle%26pos%3Dmid%26test%3D0\" alt> <\/a> <\/noscript> <\/div>\n<p>Apple is suing NSO in a San Jose federal district court for all revenues generated by Pegasus, along with compensation for its time in dealing with the outfit plus punitive damages. It also wants a permanent injunction preventing NSO from accessing Apple services, software, and devices.<\/p>\n<p>Any monies obtained from NSO will be donated to Citizen Lab, Amnesty Tech, and other non-profits that investigate spyware; Apple has pledged an additional $10m to spur efforts in the field. We note that Apple has bent over backwards for China at times, such as <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2017\/11\/22\/apple_vpns_china_skype\/\" rel=\"noopener\">banning<\/a> VPN apps in the Middle Kingdom, and <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2019\/10\/07\/apple_taiwan_flag\/\" rel=\"noopener\">censoring<\/a> iOS to appease Beijing.<\/p>\n<p>There may not be much left of NSO by the time Apple hauls it through the courts. The malware maker is already being sued by Facebook for exploiting WhatsApp to snoop on victims&#8217; devices, and earlier this month its appeal on the grounds of sovereign immunity (all of its sales are approved by the Israeli government) <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2021\/11\/09\/nso_foreign_immunity_whatsapp_decision\/\" rel=\"noopener\">was turned down<\/a> again.<\/p>\n<p>\u201cThousands of lives were saved around the world thanks to NSO Group&#8217;s technologies used by its customers,\u201d a spokesperson for the developer told us today.<\/p>\n<p>\u201cPedophiles and terrorists can freely operate in technological safe-havens, and we provide governments the lawful tools to fight it. NSO group will continue to advocate for the truth.\u201d \u00ae<\/p>\n<p> <i><b>PS:<\/b> MIT Tech Review <a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/www.technologyreview.com\/2021\/11\/23\/1040509\/france-macron-nso-in-crisis-sanctions\/\">reported<\/a> &#8220;French officials were close to buying&#8221; Pegasus tools until it emerged French politicians were potentially among previous targets of the spyware.
