US companies may still do business with named entities, but such transactions are frowned upon: &#8220;BIS considers that transactions of any nature with listed entities carry a &#8216;red flag&#8217; and recommends that US companies proceed with caution with respect to such transactions,&#8221; the Commerce Department <a href=\"https:\/\/www.bis.doc.gov\/index.php\/cbc-faqs\/faq\/281-1-what-is-the-entity-list#faq_285\" target=\"_blank\" rel=\"nofollow noopener\">explains<\/a>.<\/p>\n<p>The decision to sanction the four firms follows from <a href=\"https:\/\/www.theregister.com\/2021\/10\/20\/us_intrusion_software_rules\/\" target=\"_blank\" rel=\"noopener\">export controls<\/a> outlined last month by the Commerce Department to adopt rules consistent with the <a href=\"https:\/\/www.armscontrol.org\/factsheets\/wassenaar\">1996 Wassenaar Arrangement<\/a>, an international arms control agreement that extends to &#8220;intrusion software.&#8221;<\/p>\n<p>Positive Technologies, Candiru, and COSEINC did not immediately respond to requests for comment. <i>El Reg<\/i>&#8216;s Gareth Corfield noted earlier this isn&#8217;t the first time the US government has tried to <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2021\/04\/16\/positive_technologies_us_sanctions_groundless\/\" rel=\"noopener\">crack down<\/a> on Positive Technologies:<\/p>\n<blockquote class=\"twitter-tweet\" readability=\"7.4597315436242\">\n<p lang=\"en\" dir=\"ltr\">PT was previously sanctioned by the US but chose to carry on as if nothing had happened. Its UK arm, servicing mobile vendors, hastily deleted most of its marketing material quoting them after <a href=\"https:\/\/twitter.com\/TheRegister?ref_src=twsrc%5Etfw\">@TheRegister<\/a> asked about it. <a href=\"https:\/\/t.co\/j2vflonHCo\">https:\/\/t.co\/j2vflonHCo<\/a><\/p>\n<p>\u2014 Gareth Corfield (@GazTheJourno) <a href=\"https:\/\/twitter.com\/GazTheJourno\/status\/1455909238807711746?ref_src=twsrc%5Etfw\">November 3, 2021<\/a><\/p><\/blockquote>\n<p>In an email to <i>The Register<\/i>, NSO Group said it intends to lobby to have the decision undone.<\/p>\n<p>&#8220;NSO Group is dismayed by the decision given that our technologies support US national security interests and policies by preventing terrorism and crime, and thus we will advocate for this decision to be reversed,&#8221; a company spokesperson said.<\/p>\n<div aria-hidden=\"true\" class=\"adun\" data-pos=\"top\" data-raptor=\"falcon\" data-xsm=\",fluid,mpu,\" data-sm=\",fluid,mpu,\" data-md=\",fluid,mpu,\"> <noscript> <a href=\"https:\/\/pubads.g.doubleclick.net\/gampad\/jump?co=1&amp;iu=\/6978\/reg_security\/front&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=4&amp;c=44YYgk4O5eutYF0Lrv8pHP5AAAAFE&amp;t=ct%3Dns%26unitnum%3D4%26raptor%3Dfalcon%26pos%3Dmid%26test%3D0\" target=\"_blank\" rel=\"noopener\"> <img decoding=\"async\" src=\"https:\/\/pubads.g.doubleclick.net\/gampad\/ad?co=1&amp;iu=\/6978\/reg_security\/front&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=4&amp;c=44YYgk4O5eutYF0Lrv8pHP5AAAAFE&amp;t=ct%3Dns%26unitnum%3D426raptor%3Dfalcon%26pos%3Dmid%26test%3D0\" alt> <\/a> <\/noscript> <\/div>\n<p>&#8220;We look forward to presenting the full information regarding how we have the world\u2019s most rigorous compliance and human rights programs that are based the American values we deeply share, which already resulted in multiple terminations of contacts with government agencies that misused our products.&#8221;<\/p>\n<p>Amnesty International, which earlier this year <a href=\"https:\/\/www.theregister.com\/2021\/07\/19\/mass_misuse_of_nso_pegasus_spyware_alleged\/\" target=\"_blank\" rel=\"noopener\">published a report<\/a> in conjunction with French advocacy group Forbidden Stories alleging that NSO&#8217;s Pegasus spyware was widely used to violate human rights and to target government officials and members of civil society, described the Commerce Department&#8217;s action as confirmation of its findings.<\/p>\n<blockquote class=\"pullquote\" readability=\"6\">\n<p>This decision sends a strong message to NSO Group that it can no longer profit from human rights abuses without repercussions<\/p>\n<\/blockquote>\n<p>&#8220;With this move, the US government has acknowledged what Amnesty and other activists have been saying for years: NSO Group\u2019s spyware is a tool of repression, which has been used around the world to violate human rights,&#8221; said Danna Ingleton, deputy director of Amnesty Tech, in a statement. &#8220;This decision sends a strong message to NSO Group that it can no longer profit from human rights abuses without repercussions.&#8221;<\/p>\n<p>Ingleton described the Entity List inclusion as &#8220;a day of reckoning for NSO Group\u2019s investors&#8221; \u2013 which includes <a href=\"https:\/\/www.amnesty.org\/en\/documents\/doc10\/4903\/2021\/en\/\" target=\"_blank\" rel=\"nofollow noopener\">multiple US pension funds<\/a> through their respective stakes in NSO Group backer Novalpina Capital \u2013 and questioned whether they will be willing to continue to bankroll a firm accused of violating human rights.<\/p>\n<p>&#8220;The threats posed by surveillance technology are bigger than one company,&#8221; said Ingleton. &#8220;This dangerous industry is out of control, and this must spell the end of the impunity spyware companies have so far enjoyed. We need an immediate global moratorium on the export, sale, transfer and use of surveillance technology until there is a human rights-compliant regulatory framework in place.&#8221; \u00ae<\/p>\n<h3 class=\"crosshead\"> <span>Updated to add<\/span><br \/>\n<\/h3>\n<p>On Thursday, Positive Technologies published a <a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/www.ptsecurity.com\/ww-en\/about\/news\/positive-technologies-the-greater-the-success-the-greater-the-pressure\/\">statement<\/a> from CEO Denis Baranov on its website. He said the action by the Department of Commerce would have little or no impact on the company\u2019s business.<\/p>\n<p>&#8220;Every one of our developments is strictly protection-focused.
