The collection period in question stretches over the 12 years before former NSA sysadmin Edward Snowden brought the practice to light as well as two years after he did so (2001-2015). Secret court decisions are corrosive in a democracy, especially when they so often hand the government the power to peer into our digital lives.&#8221;<\/p>\n<p>Since the <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2015\/06\/03\/humiliation_for_mich_mcconnell_after_senate_passes_usa_freedom_act\/\" rel=\"noopener\">USA Freedom Act was passed in 2015<\/a> \u2013&nbsp;as a response to the backlash from the Snowden revelations \u2013 FISC has been forced to publish statistical information annually, but the ACLU has pointed out that any review of FISC behind-closed-doors decisions is solely &#8220;conducted &#8230; by executive branch officials, not a court.&#8221;<\/p>\n<div aria-hidden=\"true\" class=\"adun\" data-pos=\"top\" data-raptor=\"falcon\" data-xsm=\",fluid,mpu,\" data-sm=\",fluid,mpu,\" data-md=\",fluid,mpu,\"> <noscript> <a href=\"https:\/\/pubads.g.doubleclick.net\/gampad\/jump?co=1&amp;iu=\/6978\/reg_security\/front&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=4&amp;c=44YYV63GnrmiKGAy5Nz7QIaQAAABA&amp;t=ct%3Dns%26unitnum%3D4%26raptor%3Dfalcon%26pos%3Dmid%26test%3D0\" target=\"_blank\" rel=\"noopener\"> <img decoding=\"async\" src=\"https:\/\/pubads.g.doubleclick.net\/gampad\/ad?co=1&amp;iu=\/6978\/reg_security\/front&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=4&amp;c=44YYV63GnrmiKGAy5Nz7QIaQAAABA&amp;t=ct%3Dns%26unitnum%3D426raptor%3Dfalcon%26pos%3Dmid%26test%3D0\" alt> <\/a> <\/noscript> <\/div>\n<p>According to FISC&#8217;s latest report for <a target=\"_blank\" href=\"https:\/\/www.uscourts.gov\/sites\/default\/files\/fisc_annual_report_2020.pdf\" rel=\"noopener\">2020 [PDF]<\/a>, it denied only 13 of 979 applications \u2013&nbsp;approving over 98 per cent of surveillance applications by the Secret Service. If you include applications &#8220;partly denied\/amended&#8221;, this dips to over 96 per cent.<\/p>\n<p>But saying that, it might not make much difference \u2013 the NSA long ago <a href=\"https:\/\/www.theregister.com\/2014\/08\/13\/nsa_overstepped_fisc_collection_rules\/\">admitted that it had lost track<\/a> of what it was and wasn&#8217;t allowed to do. The Electronic Freedom Foundation <a href=\"https:\/\/www.theregister.com\/2016\/04\/20\/eff_sues_doj_over_fisc_foia\/\">also had a go at finding out<\/a>, but the judge let the agency keep on going. <a href=\"https:\/\/www.theregister.com\/2019\/06\/26\/nsa_spy_program_aclu\/\">And going and going<\/a>.<\/p>\n<p>The NSA even allegedly tried to <a href=\"https:\/\/www.theregister.com\/2013\/12\/21\/nsa_paid_rsa_10_million\/\">pay RSA $10m<\/a> to put a backdoor into its crypto tool, although <a href=\"https:\/\/www.theregister.com\/2013\/12\/23\/rsa_nsa_response\/\">RSA denied taking the money<\/a>. It <a href=\"https:\/\/www.theregister.com\/2014\/04\/02\/extended_random_nsa_rsa_bsafe\/\">never happened, honest guv<\/a>.<\/p>\n<p>It just <a href=\"https:\/\/www.theregister.com\/2020\/09\/03\/nsa_metadata_collection\/\">tapped a few phones<\/a>, even if it&#8217;s <a href=\"https:\/\/www.theregister.com\/2013\/07\/19\/fisa_us_surveillance_renewal\/\">not allowed to say how many<\/a>. Anyway, <a href=\"https:\/\/www.theregister.com\/2015\/01\/17\/dea_admits_that_its_also_secretly_collecting_us_telephone_metadata\/\">the DEA did it too<\/a>. And the NSA <a href=\"https:\/\/www.theregister.com\/2019\/03\/05\/nsa_spying_program\/\">might have even stopped doing that<\/a> now. Probably. Maybe.<\/p>\n<p>But US readers shouldn&#8217;t worry about it&#8230; After all, you shouldn&#8217;t worry about things you can&#8217;t control. <a href=\"https:\/\/www.theregister.com\/2020\/03\/12\/us_congress_spying_law\/\">They&#8217;re going to keep it up<\/a>. alt> <\/a> <\/noscript> <\/div>\n<p>Many of the decisions on FISC &#8211; both legislatively and politically &#8211; have been circular, and amount to: &#8220;There&#8217;s a reason why we have to keep X a secret, but it&#8217;s a secret.&#8221;<\/p>\n<p>This week&#8217;s result is less notable for the fact that the court declined to hear the case, than for two justices on either end of the political spectrum agreeing that it was out of order that secret spy courts are answerable to &#8220;no court&#8221; in America \u2013 despite the fact that broad surveillance programs are by their
