{"id":4302,"date":"2018-06-25T16:12:03","date_gmt":"2018-06-25T16:12:03","guid":{"rendered":"https:\/\/kasperskycontenthub.com\/threatpost\/?p=133056"},"modified":"2018-06-25T16:12:03","modified_gmt":"2018-06-25T16:12:03","slug":"uk-tax-agency-collects-5-1m-biometric-voice-ids-may-violate-gdpr","status":"publish","type":"post","link":"https:\/\/www.threatshub.org\/blog\/uk-tax-agency-collects-5-1m-biometric-voice-ids-may-violate-gdpr\/","title":{"rendered":"UK Tax Agency Collects 5.1M Biometric Voice IDs, May Violate GDPR"},"content":{"rendered":"<div class=\"media_block\"><\/div>\n<div><img decoding=\"async\" src=\"https:\/\/media.kasperskycontenthub.com\/wp-content\/uploads\/sites\/31\/2018\/06\/07154032\/GDPR_device_data_privacy.jpg\" class=\"ff-og-image-inserted\"\/><\/div>\n<p>Her Majesty\u2019s Revenue and Customs (HMRC) in the UK is under investigation by that country\u2019s regulator over the collection of more than 5 million biometric voice IDs.<\/p>\n<p>The Information Commissioner\u2019s Office (ICO) is investigating the tax agency\u2019s practice, which may violate the recently implemented General Data Protection Regulation, following an official complaint from watchdog group Big Brother Watch. Among other problematic developments, the advocacy organization said that information on how individuals can easily and securely have their voiceprint deleted is not publicly accessible, and that the collection of the voiceprint is not being done with explicit consumer consent.<\/p>\n<p>Since January 2017, HMRC <a href=\"https:\/\/www.gov.uk\/government\/news\/voice-id-showcases-latest-digital-development-for-hmrc-customers\">has been taking voice recordings<\/a> from those who call the department\u2019s tax credits and self-assessment helplines to create a voiceprint that will be used to identify callers in the future. Billed as a boon for efficiency and making citizens\u2019 lives better, the Voice ID technology that HMRC uses analyzes unique voice patterns and rhythms to identify a person using just their voice \u2013 this involves checking over 100 behavioral and physical vocal traits, including the size and shape of someone\u2019s mouth, how fast he or she talks, and general diction and how words are emphasized.<\/p>\n<p>\u201cBiometric voice ID is not the same as Automatic Speech Recognition (ASR), which automatically identifies words spoken and is not necessarily unique to each person. A biometric voice ID is a voiceprint that is unique to each individual,\u201d explained Big Brother Watch, in a <a href=\"https:\/\/bigbrotherwatch.org.uk\/2018\/06\/hmrc\/\">posting<\/a> on the situation on Sunday.<\/p>\n<p>As such, because voiceprints are such sensitive data \u2013 and voice IDs are not necessary for dealing with tax issues \u2013 HMRC must also <a href=\"https:\/\/ico.org.uk\/for-organisations\/guide-to-the-general-data-protection-regulation-gdpr\/lawful-basis-for-processing\/consent\/\">request the explicit consent<\/a> of each taxpayer to enroll them in the scheme, as required by Article 9 of GDPR, which was made into UK law via its Data Protection Act. The GDPR also requires the right of erasure, in which any citizen has the right to request his or her private information be deleted \u2013 and that the process for doing so is transparent and straightforward.<\/p>\n<p>But instead of explicit consent, HMRC said that it will \u201cbe encouraging customers who call to take advantage of the Voice ID service, but they can choose to opt-out and continue to use HMRC\u2019s services in the usual way if they prefer.\u201d<\/p>\n<p>To boot, the opt-out process is not very straightforward. In the Big Brother Watch investigation and <a href=\"https:\/\/bigbrotherwatch.org.uk\/2018\/06\/hmrc\/\">call transcripts<\/a>, the automated voice assistant that answers when citizens call in will repeatedly \u2013 and more insistently each time \u2013 ask the caller to repeat the phrase \u201cMy voice is my password\u201d before being able to access services; and only after three proactive \u201cno\u201d responses does it default to a different method.<\/p>\n<p>The automated attendant then says, \u201cSorry, I wasn\u2019t able to create a Voice ID for you. This is often because of background noise or a bad connection. Don\u2019t worry \u2013 next time we\u2019re able to offer you Voice ID, we\u2019ll try again. Please hold on a moment and I\u2019ll transfer you to one of our advisors.\u201d<\/p>\n<p>Big Brother Watch also submitted Freedom of Information requests to find out more about how the government is storing and handling the voiceprints, revealing that it has so far collected 5.1 million of them.<\/p>\n<p>\u201cHowever, HMRC has <a href=\"https:\/\/bigbrotherwatch.org.uk\/wp-content\/uploads\/2018\/06\/HMRC-FOI-5.4.18-refusals.pdf\">refused to disclose<\/a> which other Government departments the voice IDs have been shared with, how the IDs are stored and used, whether it is possible to delete a voice ID, which legal territory the data is kept in, how much the scheme has cost taxpayers, or the legally-required \u2018privacy impact assessment\u2019,\u201d Big Brother Watch said.<\/p>\n<p>In one of the FOI requests, HMRC declined to discuss its erasure methodology.<\/p>\n<p>\u201cWe sent HMRC a Freedom of Information request, asking how an individual could securely delete their voice ID and use the usual method to access the helpline,\u201d Big Brother Watch said. \u201cDisturbingly, HMRC <a href=\"https:\/\/bigbrotherwatch.org.uk\/wp-content\/uploads\/2018\/06\/HMRC-FOI-30.4.18-5million-no-erasure.pdf\">refused to answer our question<\/a> under FOIA Exemption s31 (1) (a) \u2013 prejudice to the prevention or detection of crime.\u201d<\/p>\n<p>The group\u2019s investigation found that it\u2019s possible to unselect the use of Voice ID as a security check by calling in and talking to an HMRC adviser, but that the deletion of the actual record as provided for by the GDPR requires a person to submit a data subject access form. The problem, according to Big Brother Watch, is that finding out the information on how to have a voiceprint deleted is far from easily accessible, with no information to be gleaned on how to do it short of calling in and speaking to someone at HMRC.<\/p>\n<p>\u201cThere\u2019s a form you can fill in there if you have a look at gov.uk and search for HMRC Subject Access Request,\u201d the advisor told a Big Brother Watch representative during the investigation, once the investigator was finally connected to a live person and after back-and-forth questioning.<\/p>\n<p>Big Brother Watch isn\u2019t the only privacy group concerned about the situation.<\/p>\n<p>\u201cHMRC\u2019s voiceprint scheme appears to be almost surreptitious, failing to meet basic data protection principles,\u201d Pat Walshe, data protection law expert and director of Privacy Matters, said in a media statement. \u201cThe non-transparent manner harvesting of people\u2019s data and significant questions of lawfulness are troubling. Given the significant number of citizens involved, and the potential for broader use of biometric voiceprints by government agencies, the ICO could issue a notice requiring the temporary suspensions of the scheme.\u201d<\/p>\n<p>Even so, the HMRC seemed unconcerned in an official statement: \u201cOur Voice ID system is very popular with customers as it gives a quick and secure route into our systems.
