However, though the Trump administration OK\u2019d the decision, officials apparently left the notification part for the Biden administration to deal with. I guess they just never got around to it. Probably too busy inspiring an insurrection and trying to overthrow the presidential election.<\/p>\n<p class=\"sc-77igqf-0 bOfvBY\">In three separate letters dated May 3 addressed to reporters Ellen Nakashima, Greg Miller, and former reporter Adam Entous, the Justice Department wrote they were \u201chereby notified that pursuant to legal process the United States Department of Justice received toll records associated with the following telephone numbers for the period from April 15, 2017 to July 31, 2017,\u201d according to the Post. Listed were Miller\u2019s work and cellphone numbers, Entous\u2019 cellphone number, and Nakashima\u2019s work, cellphone, and home phone numbers. These records included all calls to and from the phones as well as how long each call lasted but did not reveal what was said. <\/p>\n<p class=\"sc-77igqf-0 bOfvBY\">According to the letters, the Post reports that prosecutors also secured a court order to seize \u201cnon content communications records\u201d for the reporters\u2019 email accounts, which would disclose who emailed whom and when the emails were sent but not their contents. However, officials ultimately did not obtain these records, the outlet said. <\/p>\n<p class=\"sc-77igqf-0 bOfvBY\"> \u201cWe are deeply troubled by this use of government power to seek access to the communications of journalists,\u201d said the Post\u2019s acting executive editor Cameron Barr. \u201cThe Department of Justice should immediately make clear its reasons for this intrusion into the activities of reporters doing their jobs, an activity protected under the First Amendment.\u201d<\/p>\n<div class=\"bxm4mm-19 fIUNXF\" readability=\"3.1090909090909\">\n<div class=\"sc-1atgi65-0 sc-1atgi65-1 bdNdA-D js_commerce-inset-permalink\" data-inset-url=\"https:\/\/caliper-cbd.sjv.io\/c\/379647\/866935\/12080?subId1=-&amp;u=https%3A%2F%2Ftrycaliper.com%2F\" data-inset-category=\"CommerceInsetMobile\" readability=\"3.6272727272727\">\n<p>G\/O Media may get a commission<\/p>\n<\/div>\n<\/div>\n<p class=\"sc-77igqf-0 bOfvBY\">Frustratingly, the letters apparently don\u2019t go into <em>why <\/em>the Department of Justice seized this data. A department spokesperson told the outlet that the decision to do so was made in 2020 during the Trump administration. (It\u2019s worth noting that former President Donald Trump has made it crystal clear that he despises news media and the government leakers that provide them their scoops.)<\/p>\n<p class=\"sc-77igqf-0 bOfvBY\">Based on the time period cited in the letters and what the reporters covered during those months, the Post speculates that their investigations into Sessions and Russian interference could be why the department wanted to get its hands on their phone data. <\/p>\n<div id class=\"bxm4mm-11 gamHXh js_ad-mobile-dynamic js_ad-dynamic ad-mobile-dynamic movable-ad\">\n<div class=\"bxm4mm-12 iqioLK ad-unit ad-mobile\">\n<p>Advertisement<\/p>\n<\/div>\n<\/div>\n<p class=\"sc-77igqf-0 bOfvBY\">During that time period, the three reporters published <span><a class=\"sc-1out364-0 hMndXN sc-145m8ut-0 kVnoAv js_link\" data-ga=\"[[&quot;Embedded Url&quot;,&quot;External link&quot;,&quot;https:\/\/www.washingtonpost.com\/world\/national-security\/sessions-discussed-trump-campaign-related-matters-with-russian-ambassador-us-intelligence-intercepts-show\/2017\/07\/21\/3e704692-6e44-11e7-9c15-177740635e83_story.html?itid=lk_inline_manual_18&quot;,{&quot;metric25&quot;:1}]]\" href=\"https:\/\/www.washingtonpost.com\/world\/national-security\/sessions-discussed-trump-campaign-related-matters-with-russian-ambassador-us-intelligence-intercepts-show\/2017\/07\/21\/3e704692-6e44-11e7-9c15-177740635e83_story.html?itid=lk_inline_manual_18\" target=\"_blank\" rel=\"noopener noreferrer\">a story<\/a><\/span> detailing federal correspondence that indicated then-Sen. Sessions of Alabama had discussed the Trump campaign in 2016 with Sergey Kislyak, Russia\u2019s ambassador to the U.S. at the time. In that same period, the reporters <span><a class=\"sc-1out364-0 hMndXN sc-145m8ut-0 kVnoAv js_link\" data-ga=\"[[&quot;Embedded Url&quot;,&quot;External link&quot;,&quot;https:\/\/www.washingtonpost.com\/graphics\/2017\/world\/national-security\/obama-putin-election-hacking\/?itid=lk_inline_manual_20&quot;,{&quot;metric25&quot;:1}]]\" href=\"https:\/\/www.washingtonpost.com\/graphics\/2017\/world\/national-security\/obama-putin-election-hacking\/?itid=lk_inline_manual_20\" target=\"_blank\" rel=\"noopener noreferrer\">also wrote about<\/a><\/span> how the Obama administration struggled to counter Russian interference in the 2016 election. <\/p>\n<p class=\"sc-77igqf-0 bOfvBY\">Sessions, who later acted as Trump\u2019s attorney general from 2017 to 2018, held <span><a class=\"sc-1out364-0 hMndXN sc-145m8ut-0 kVnoAv js_link\" data-ga=\"[[&quot;Embedded Url&quot;,&quot;External link&quot;,&quot;https:\/\/apnews.com\/article\/8185ce2acac04d6391567e7e23f98594&quot;,{&quot;metric25&quot;:1}]]\" href=\"https:\/\/apnews.com\/article\/8185ce2acac04d6391567e7e23f98594\" target=\"_blank\" rel=\"noopener noreferrer\">a news conference<\/a><\/span> in August 2017, just four days after the time period cited in the letters, where he committed to ramping up efforts to suss out and prosecute government leakers. <\/p>\n<div id class=\"bxm4mm-11 gamHXh js_ad-mobile-dynamic js_ad-dynamic ad-mobile-dynamic movable-ad\">\n<div class=\"bxm4mm-12 iqioLK ad-unit ad-mobile\">\n<p>Advertisement<\/p>\n<\/div>\n<\/div>\n<p class=\"sc-77igqf-0 bOfvBY\">\u201cThis culture of leaking must stop,\u201d Sessions said at the time. <\/p>\n<p class=\"sc-77igqf-0 bOfvBY\">For the Justice Department to subpoena records of reporters, it must have exhausted all possible avenues for obtaining that information and secured the attorney general\u2019s approval, according to the agency\u2019s regulations. On Friday, Justice Department<strong> <\/strong>spokesperson Marc Raimondi told the Post it\u2019s<!-- --> considered a last resort that the agency doesn\u2019t take lightly:<\/p>\n<blockquote data-type=\"BlockQuote\" class=\"sc-8hxd3p-0 gZJbdR\" readability=\"9\">\n<p class=\"sc-77igqf-0 bOfvBY\"> \u201cWhile rare, the Department follows the established procedures within its media guidelines policy when seeking legal process to obtain telephone toll records and non-content email records from media members as part of a criminal investigation into unauthorized disclosure of classified information. The targets of these investigations are not the news media recipients but rather those with access to the national defense information who provided it to the media and thus failed to protect it as lawfully required.\u201d<\/p>\n<\/blockquote>\n<div id class=\"bxm4mm-11 gamHXh js_ad-mobile-dynamic js_ad-dynamic ad-mobile-dynamic movable-ad\">\n<div class=\"bxm4mm-12 iqioLK ad-unit ad-mobile\">\n<p>Advertisement<\/p>\n<\/div>\n<\/div>\n<p class=\"sc-77igqf-0 bOfvBY\">Regardless, the news sparked fierce condemnation from media organizations, who argued the Justice Department\u2019s actions may have violated the First Amendment. Bruce Brown, the executive director of the Reporters Committee for Freedom of the Press, called it \u201cimperative\u201d that the Justice Department explain its reasoning and why the agency is only just now notifying the Post months after the decision was made.<\/p>\n<p class=\"sc-77igqf-0 bOfvBY\">\u201cIt is imperative that the new Justice Department leadership explain exactly when prosecutors seized these records, why it is only now notifying the Post, and on what basis the Justice Department decided to forgo the presumption of advance notification under its own guidelines when the investigation apparently involves reporting over three years in the past,\u201d he said <span><a class=\"sc-1out364-0 hMndXN sc-145m8ut-0 kVnoAv js_link\" data-ga=\"[[&quot;Embedded
