lawsuit<\/h2>\n<p><a href=\"https:\/\/www.theregister.com\/2021\/03\/23\/supreme_court_facebook\/\"><span>READ MORE<\/span><\/a><\/div>\n<div aria-hidden=\"true\" class=\"adun\" data-pos=\"mid\" data-raptor=\"eagle\" data-xsm=\",button,mpu_plusplus,\" data-sm=\",button,mpu_plusplus,\" data-md=\",button,mpu_plusplus,\"> <noscript> <a href=\"https:\/\/pubads.g.doubleclick.net\/gampad\/jump?co=1&amp;iu=\/6978\/reg_security\/front&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=3&amp;c=33YGKBrMW19JKTyNrHu86L0AAAAAI&amp;t=ct%3Dns%26unitnum%3D3%26raptor%3Deagle%26pos%3Dmid%26test%3D0\" target=\"_blank\" rel=\"noopener noreferrer\"> <img decoding=\"async\" src=\"https:\/\/pubads.g.doubleclick.net\/gampad\/ad?co=1&amp;iu=\/6978\/reg_security\/front&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=3&amp;c=33YGKBrMW19JKTyNrHu86L0AAAAAI&amp;t=ct%3Dns%26unitnum%3D3%26raptor%3Deagle%26pos%3Dmid%26test%3D0\" alt> <\/a> <\/noscript> <\/div>\n<p>The lawsuit has been brought under the <a href=\"http:\/\/www.leg.state.fl.us\/Statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0900-0999\/0934\/0934.html\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">2020 Florida Security of Communications Act<\/a>, which makes it a crime to intentionally intercept another person&#8217;s electronic communications without prior consent.<\/p>\n<p>Londers&#8217;s complaint does not specify the session replay software involved but <i>The Register<\/i> understands from a conversation with one of the attorneys involved that it&#8217;s believed to be Clicktale, which was <a href=\"https:\/\/www.prnewswire.com\/news-releases\/contentsquare-acquires-clicktale-to-create-the-definitive-global-leader-in-experience-analytics-300878232.html\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">acquired<\/a> in 2019 by Contentsquare, a maker of similar analytics software.<\/p>\n<p>As Jonathan Cherki, founder and CEO of Contentsquare, described the deal at the time, &#8220;The combination of Clicktale and Contentsquare heralds an unprecedented goldmine of digital data that enables companies to interpret and predict the impact of any digital element \u2013 including user experience, content, price, reviews and product \u2013 on visitor behavior.&#8221;<\/p>\n<p>Non-profit org The Markup&#8217;s Blacklight web inspector <a href=\"https:\/\/themarkup.org\/blacklight?url=www.intel.com\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">warns<\/a> that the Intel website contains a Clicktale script with &#8220;a session recorder, which tracks user mouse movement, clicks, taps, scrolls, or even network activity.&#8221; The privacy scanner further notes that no keystroke logging was detected and that it cannot say how the session data is being used.<\/p>\n<h3 class=\"crosshead\"> <span>But other folks can<\/span><br \/>\n<\/h3>\n<p>Session replay software saw increased attention from the privacy community in 2017 when researchers from Princeton&#8217;s Center for Information Technology Policy <a href=\"https:\/\/freedom-to-tinker.com\/2017\/11\/15\/no-boundaries-exfiltration-of-personal-data-by-session-replay-scripts\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">published a study<\/a> in which they looked at the prevalence of the seven most popular session replay services at the time \u2013 Yandex, FullStory, Hotjar, UserReplay, Smartlook, Clicktale, and SessionCam \u2013 and found their scripts being used on 482 of the Alexa top 50,000 websites.<\/p>\n<p>The following year, session replay scripts were discussed at a US Federal Trade Commission event, FTC PrivCon 2018. During the session [<a href=\"https:\/\/www.ftc.gov\/system\/files\/documents\/videos\/privacy-con-2018-part-1\/ftc_privacycon_2018_-_transcript_segment_1.pdf\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">PDF<\/a>], Gunes Acar, who at the time was a postdoctoral researcher with the Princeton CITP project and is currently with the COSIC research group of KU Leuven, described the privacy risk posed by session replay services.<\/p>\n<div class=\"promo_article\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/regmedia.co.uk\/2021\/03\/16\/incognito.jpg?x=174&amp;amp;y=115&amp;amp;crop=1\" width=\"174\" height=\"115\" alt=\"incognito\"><\/p>\n<h2 title=\"Judge Lucy Koh allows legal challenge to move forward\">Google fails to neutralize lawsuit that complains Chrome&#8217;s incognito mode isn&#8217;t very private at all<\/h2>\n<p><a href=\"https:\/\/www.theregister.com\/2021\/03\/17\/google_incognito_lawsuit\/\"><span>READ MORE<\/span><\/a><\/div>\n<p>Session replay scripts, Acar said, are no worse than any other analytics scripts until it comes to web input forms. There&#8217;s risk, said Acar, that sensitive information like email addresses, credit card numbers, and passwords will get captured by these replay scripts \u2013 the Princeton researchers found replay service providers often fail to keep sensitive data safe.<\/p>\n<p>However, the attorney on the Florida case who spoke with <i>The Register<\/i> said the central issue is whether website visitors gave informed consent. And he voiced optimism that the Florida cases will survive motions to dismiss because Florida&#8217;s wiretapping law is a strong consumer protection statute.<\/p>\n<p>Since <a href=\"https:\/\/digitalcommons.law.scu.edu\/historical\/1611\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Cohen v. Casper Sleep<\/a> (2017) in New York, there have been at least two dozen such wiretapping privacy claims, mostly in California and Florida \u2013 both states with applicable privacy statutes. Those who have been sued over this <a href=\"https:\/\/www.classaction.org\/search?q=session+replay\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">include<\/a> Banana Republic, Blizzard, CVS, Fandango, Foot Locker, Frontier Airlines, General Motors, Home Depot, Old Navy, Nike, Norton, Ray-Ban, T-Mobile, and WedMD, among others.<\/p>\n<p>The New York case was dismissed in 2018 for failure to properly state a claim [<a href=\"https:\/\/ia800108.us.archive.org\/24\/items\/gov.uscourts.nysd.484544\/gov.uscourts.nysd.484544.57.0.pdf\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">PDF<\/a>]. But most of the California and Florida cases continue to plod along and may yet make it to trial, or more likely, settlement.<\/p>\n<p>These claims got a boost from the 2020 Ninth Circuit Court of Appeals decision [<a href=\"https:\/\/cdn.ca9.uscourts.gov\/datastore\/opinions\/2020\/04\/09\/17-17486.pdf\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">PDF<\/a>] that refused to dismiss wiretapping claims against Facebook for tracking people even when they&#8217;ve logged out of the social networking service. A week ago, the <a href=\"https:\/\/www.theregister.com\/2021\/03\/23\/supreme_court_facebook\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">US Supreme Court declined<\/a> to hear Facebook&#8217;s appeal to undo that decision.<\/p>\n<div aria-hidden=\"true\" class=\"adun\" data-pos=\"top\" data-raptor=\"falcon\" data-xsm=\",button,dbutton,mpu_plus,dmpu,\"
