{"id":37902,"date":"2020-10-29T07:02:14","date_gmt":"2020-10-29T07:02:14","guid":{"rendered":"https:\/\/www.threatshub.org\/blog\/french-services-outfit-atos-told-to-pay-855m-in-trade-secret-pinching-case\/"},"modified":"2020-10-29T07:02:14","modified_gmt":"2020-10-29T07:02:14","slug":"french-services-outfit-atos-told-to-pay-855m-in-trade-secret-pinching-case","status":"publish","type":"post","link":"https:\/\/www.threatshub.org\/blog\/french-services-outfit-atos-told-to-pay-855m-in-trade-secret-pinching-case\/","title":{"rendered":"French services outfit Atos told to pay $855m in trade secret pinching case"},"content":{"rendered":"<div><img decoding=\"async\" src=\"https:\/\/regmedia.co.uk\/2018\/06\/11\/shutterstock_525083920.jpg\" class=\"ff-og-image-inserted\"><\/div>\n<p>French services outfit Atos has been ordered to pay $855m for pinching a rival\u2019s trade secrets.<\/p>\n<p>The source of the case is Syntel, an automation outfit that Atos <a href=\"https:\/\/www.theregister.com\/2018\/07\/23\/atos_syntel_acquisition_34bn\/\">acquired for $3.4bn<\/a> back in 2018.<\/p>\n<p>Atos bought Syntel despite knowing it was embroiled in a dispute with a company called TriZetto, which provides healthcare services and software.<\/p>\n<p>Syntel and TriZetto started out as business partners, with Syntel staff contracted to help TriZetto\u2019s development efforts. But in 2014 TriZetto was acquired by Cognizant, a rival to Syntel, and terminated the partnership. It first was alleged that Syntel used confidential information it obtained as a service provider to TriZetto to sabotage it once news of the acquisition emerged.<\/p>\n<p>Years of litigation and counterclaims followed, culminating in a recent jury trial that concluded on Tuesday with a jury in the United States District Court for the Southern District of New York found that TriZetto had been sinned against.<\/p>\n<p>Jurors were asked to assess damages and their <a href=\"https:\/\/regmedia.co.uk\/2020\/10\/29\/TriZetto_syntel_jury.pdf\">conclusion<\/a> [PDF] was that Syntel, now owned by Atos, needs to cough up $854,565,576\u202c in damages, $569,710,384 of that punitive.<\/p>\n<p>Atos quickly emitted a <a href=\"https:\/\/atos.net\/en\/2020\/press-release_2020_10_28\/statement-from-atos-4\">statement<\/a> that declares the decision a dud on grounds that \u201cthe jury\u2019s verdict is not supported by the evidence presented during the trial or the applicable law.\u201d Atos also reckons that the damages are \u201cgrossly out of proportion to the acts complained of\u201d<\/p>\n<p>The French firm has a rather different figure in mind: \u201capproximately $8.5 million.\u201d<\/p>\n<p>The matter is therefore now back on the desk of judge Lorna G. Schofield. <i>The Register<\/i> imagines Atos will be rather keen to have the damages reduced, because the $855m order represents rather a substantial chunk of \u20ac11,588 million annual revenue from
