Orca sees itself as a competitor of Palo Alto Networks (PAN).<\/p>\n<p>\u201cWhat we expected is that others will also create such materials &#8230; but instead we received a letter from Palo Alto\u2019s lawyers claiming we ware not allowed to do that,\u201d Orca chief exec Avi Shua told <i>The Register<\/i> this week. \u201cWe believe these are empty legal threats.\u201d<\/p>\n<p>In a note on its website, Orca lamented <a target=\"_blank\" rel=\"nofollow noopener noreferrer\" href=\"https:\/\/orca.security\/cybersecurity-community-transparency\/\">at length<\/a> the \u201coutrageous\u201d behavior of PAN, as well as posting a copy of the lawyer\u2019s letter for world-plus-dog to read. That letter claimed Orca infringed PAN&#8217;s trademarks by using its name and logo in the review as well as breaching non-review clauses in the End-User License Agreement (EULA) of PAN&#8217;s product.<\/p>\n<p>As such, the lawyer demanded the removal of the comparison material, and that the startup stop using PAN&#8217;s logo and name. We note the <a target=\"_blank\" rel=\"nofollow noopener noreferrer\" href=\"https:\/\/www.youtube.com\/playlist?list=PLDnqJTEi6ynvsGkSJHYeEmhz6_NfzKgbf\">videos are still online<\/a>, hosted by YouTube.<\/p>\n<div class=\"promo_article\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/regmedia.co.uk\/2017\/05\/03\/panic_shutterstock.jpg?x=174&amp;y=115&amp;crop=1\" width=\"174\" height=\"115\" alt=\"panic\"><\/p>\n<h2 title=\"Getting to be a real PAN in the OS\">If you haven&#8217;t potentially exposed 1000s of customers once again with networking vulns, step forward&#8230; Not so fast, Palo Alto Networks<\/h2>\n<p><a href=\"https:\/\/www.theregister.com\/2020\/07\/09\/palo_alto_fix\/\"><span>READ MORE<\/span><\/a><\/div>\n<p>\u201cIt\u2019s outrageous that the world\u2019s largest cybersecurity vendor, its products being used by over 65,000 organizations according to its website, believes that its users aren\u2019t entitled to share any benchmark or performance comparison of its products,\u201d said Orca.<\/p>\n<p>The lawyer\u2019s letter [<a target=\"_blank\" href=\"https:\/\/orca.security\/wp-content\/uploads\/PANW-Legal-Letter-Cease-Desist.pdf\" rel=\"noopener noreferrer\">PDF<\/a>] claimed Orca violated PAN\u2019s EULA fine-print, something deputy general counsel Melinda Thompson described in her missive as \u201ca clear breach\u201d of terms \u201cprohibiting an end user from disclosing, publishing or otherwise making publicly available any benchmark, performance or comparison tests\u2026 run on Palo Alto Networks products, in whole or in part.\u201d<\/p>\n<p>Shua told <i>The Register<\/i> Orca tried to give its rival a fair crack of the whip: \u201cEven if we tried to be objective, we would have some biases. But we did try to do it as objectively as possible, by showing it to users: creating labs, screenshots, and showing how it looks like.\u201d The fairness of the review, we note, is not what is at issue here: PAN forbids any kind of benchmarking and comparison of its gear.<\/p>\n<p>Palo Alto networks declined to comment when contacted by <i>The Register<\/i>.<\/p>\n<p>Orca\u2019s boss believes a law in PAN\u2019s home state of California makes it impossible to prohibit the publishing of reviews, and also cited a case in New York where <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2002\/02\/07\/ny_sues_nai_so_you\/\" rel=\"noopener noreferrer\">prosecutors sued McAfee<\/a>, under its short-lived corporate name of Network Associates Inc, for banning reviews in its EULAs.<\/p>\n<p>When asked what he thought the outcome of this latest battle would be, Shua said he hoped PAN would \u201csimply remove these clauses from the EULA,\u201d insisting \u201cso many people from the industry\u201d don\u2019t support bans on reviews. He also added, in another shot across PAN\u2019s bows, that if formal legal action ensues, \u201cit\u2019ll cost us a lot of money but it won\u2019t break Orca.
