Both measures passed unanimously, <a href=\"https:\/\/www.opb.org\/article\/2020\/09\/09\/portland-passes-nations-toughest-restriction-on-facial-recognition-technology\/\">according to<\/a> local NPR and PBS affiliate Oregon Public Broadcasting. <\/p>\n<p>The first ordinance (<a href=\"https:\/\/static1.squarespace.com\/static\/5967c18bff7c50a0244ff42c\/t\/5f3ab2af992f72493f0842c5\/1597682351767\/Ordinance+to+ban+Facial+Recognition+Ordinance+City+use+-final.pdf\">PDF<\/a>) bans the &#8220;acquisition and use&#8221; of facial recognition technologies by any bureau of the city of Portland. The second (<a href=\"https:\/\/static1.squarespace.com\/static\/5967c18bff7c50a0244ff42c\/t\/5f3ad787ba3fd27776e444af\/1597691785249\/Ordinance+to+ban+use+of+FRT+in+Places+of+Public+Accommodation+plus+code+amendment+-Final.pdf\">PDF<\/a>) prohibits private entities from using facial recognition technologies &#8220;in <a href=\"https:\/\/www.oregonlaws.org\/ors\/659A.400\">places of public accommodation<\/a>&#8221; in the city.<\/p>\n<p>Both ordinances hold that facial recognition technology has a disparate impact on underprivileged communities, particularly people of color and people with disabilities, and that those disproportionate effects fall afoul of the city&#8217;s commitment to &#8220;human rights principles such as privacy and freedom of expression.&#8221; Any framework for city use of facial recognition and other technologies must include &#8220;impacted communities and transparent decision-making authority&#8221; to ensure that the city does not &#8220;harm civil rights and civil liberties.&#8221;<\/p>\n<p>The city also explicitly recognizes a degree of privacy as one of those rights. &#8220;Portland residents and visitors should enjoy access to public spaces with a reasonable assumption of anonymity and personal privacy,&#8221; the second ordinance reads. &#8220;This is true for particularly those who have been historically over-surveilled and experience surveillance technologies differently.&#8221;<\/p>\n<p>The technologies &#8220;have been documented to have an unacceptable gender and racial bias,&#8221; the ordinance continues. Since the city does not have the infrastructure at this time to evaluate, rate, and certify every possible technology in-depth for bias, Portland &#8220;needs to take precautionary actions until these technologies are certified and safe to use and civil liberties issues are resolved.&#8221;<\/p>\n<p>The ordinance governing city agencies is effective immediately; the ban on private use will go into effect on January 1.<\/p>\n<h2>Creeping concerns<\/h2>\n<p>As facial recognition technology has proliferated, so, too, have concerns about its use and impact.<\/p>\n<p>Repeated studies have indeed shown that facial recognition algorithms currently in use <a href=\"https:\/\/news.mit.edu\/2018\/study-finds-gender-skin-type-bias-artificial-intelligence-systems-0212\">do not work equally well<\/a> on all populations. By and large, software tends to work reasonably well on men, younger people, and white people but performs <a href=\"https:\/\/www.nist.gov\/news-events\/news\/2019\/12\/nist-study-evaluates-effects-race-age-sex-face-recognition-software\">significantly worse<\/a> on women, older people, and people who are Black, Native American, or Asian and Pacific Islanders. The addition of masks to the mix <a href=\"https:\/\/www.nist.gov\/news-events\/news\/2020\/07\/nist-launches-studies-masks-effect-face-recognition-software\">does not improve<\/a> the accuracy rate of the software. <\/p>\n<p>Portland is the fifth US city to pass some kind of restriction on facial recognition software. The city of San Francisco <a href=\"https:\/\/www.nytimes.com\/2019\/05\/14\/us\/facial-recognition-ban-san-francisco.html\">banned police and government use<\/a> of facial recognition software in 2019. Nearby Oakland, California, followed <a href=\"https:\/\/www.sfchronicle.com\/bayarea\/article\/Oakland-bans-use-of-facial-recognition-14101253.php\">later that year<\/a>. In between San Francisco and Oakland, Somerville, Massachusetts, a Boston suburb, <a href=\"https:\/\/www.bostonglobe.com\/metro\/2019\/06\/27\/somerville-city-council-passes-facial-recognition-ban\/SfaqQ7mG3DGulXonBHSCYK\/story.html\">passed a similar ban<\/a>, and the city of Boston proper joined the club <a href=\"https:\/\/www.wbur.org\/news\/2020\/06\/23\/boston-facial-recognition-ban\">this summer<\/a>.<\/p>\n<p>Even agencies that do rely on facial recognition technologies may not exactly be getting their money&#8217;s worth out of it. Following a <a href=\"https:\/\/arstechnica.com\/tech-policy\/2020\/06\/police-arrested-wrong-man-based-on-facial-recognition-fail-aclu-says\/\">complaint by the ACLU<\/a> that Detroit police arrested the wrong man based on a software-generated false-positive match, <a href=\"https:\/\/arstechnica.com\/tech-policy\/2020\/06\/detroit-police-chief-admits-facial-recognition-is-wrong-96-of-the-time\/\">Detroit&#8217;s police chief admitted<\/a> the software his department uses would fail &#8220;96 percent of the time.&#8221;<\/p>\n<p> READ MORE <a
