{"id":33533,"date":"2020-02-25T14:59:59","date_gmt":"2020-02-25T14:59:59","guid":{"rendered":"https:\/\/packetstormsecurity.com\/news\/view\/30964\/Apple-May-Be-Forced-To-Disclose-China-Censorship-Requests.html"},"modified":"2020-02-25T14:59:59","modified_gmt":"2020-02-25T14:59:59","slug":"apple-may-be-forced-to-disclose-china-censorship-requests","status":"publish","type":"post","link":"https:\/\/www.threatshub.org\/blog\/apple-may-be-forced-to-disclose-china-censorship-requests\/","title":{"rendered":"Apple May Be Forced To Disclose China Censorship Requests"},"content":{"rendered":"<div><img decoding=\"async\" src=\"https:\/\/i.guim.co.uk\/img\/media\/8956f0f5a1139f32ba51e05dcc2c9b55281c0c86\/0_184_3500_2100\/master\/3500.jpg?width=1200&amp;height=630&amp;quality=85&amp;auto=format&amp;fit=crop&amp;overlay-align=bottom%2Cleft&amp;overlay-width=100p&amp;overlay-base64=L2ltZy9zdGF0aWMvb3ZlcmxheXMvdGctZGVmYXVsdC5wbmc&amp;enable=upscale&amp;s=62780cf736906b6d3fe1bc900ba8088f\" class=\"ff-og-image-inserted\"><\/div>\n<p>Apple could be forced to disclose details of censorship requests from <a href=\"https:\/\/www.theguardian.com\/world\/china\" data-link-name=\"auto-linked-tag\" data-component=\"auto-linked-tag\" class=\"u-underline\">China<\/a> and other nations after two major shareholder groups backed a proposal that would force the tech firm to make new human rights commitments.<\/p>\n<p>The motion, set to be voted on by the company\u2019s investors on Wednesday, was prompted by numerous allegations of <a href=\"https:\/\/www.theguardian.com\/technology\/apple\" data-link-name=\"auto-linked-tag\" data-component=\"auto-linked-tag\" class=\"u-underline\">Apple<\/a> kowtowing to Beijing and blocking apps from being used by Chinese customers.<\/p>\n<aside class=\"element element-rich-link element--thumbnail element-rich-link--not-upgraded\" data-component=\"rich-link\" data-link-name=\"rich-link-1 | 1\">\n<div class=\"rich-link\">\n<div class=\"rich-link__container\">\n<div class=\"rich-link__header\">\n<h2 class=\"rich-link__title\">Apple warns of coronavirus causing iPhone shortages<\/h2>\n<\/div><\/div>\n<\/div>\n<\/aside>\n<p>If approved by investors, the scheme could have implications beyond China and potentially expose details of tensions between Apple and other jurisdictions. The California-headquartered tech giant has regularly <a href=\"https:\/\/www.theguardian.com\/us-news\/2020\/jan\/14\/fbi-apple-faceoff-iphone-florida-shooting\" data-link-name=\"in body link\" class=\"u-underline\">clashed with the US government<\/a>, including most prominently over requests for iPhones to be unlocked.<\/p>\n<p>The human rights resolution was put forward by campaign group <a href=\"https:\/\/www.sumofus.org\/\" data-link-name=\"in body link\" class=\"u-underline\">SumOfUs<\/a>, which cited several concerns about Apple\u2019s relationship with the Chinese state in its submission to investors.<\/p>\n<p>Apple failed in an attempt to block the vote from taking place. And now the Guardian has learned that the proposal has the support of the influential corporate governance groups ISS and Glass Lewis.<\/p>\n<p>Together these two firms advise the world\u2019s largest institutional investors on how they vote at company\u2019s annual meetings, so their backing for the proposal is a coup for SumOfUs.<\/p>\n<p>Ahead of Wednesday\u2019s annual meeting, ISS and Glass Lewis have sent reports to their clients, seen by the Guardian, explaining why they should back the proposal.<\/p>\n<p>Glass Lewis said: \u201c[W]e believe that it would be prudent for the company to exhibit enhanced transparency around how it respects the right to free expression.\u201d<\/p>\n<p>In their reports, both Glass Lewis and ISS highlighted various news reports of Apple making apps unavailable in China.<\/p>\n<p>In 2016, it emerged that Apple had removed its iBooks Store and iTunes Movies services from devices owned by Chinese customers. In 2017, it removed several virtual private network (VPN) apps, which were used by Chinese citizens to bypass state censorship apparatus. And last year the company <a href=\"https:\/\/www.theguardian.com\/technology\/2019\/oct\/10\/tim-cook-apple-hong-kong-mapping-app-removal\" data-link-name=\"in body link\" class=\"u-underline\">removed HKMap.Live<\/a>, a controversial crowdsourced mapping app that was being used by Hong Kong protesters to track police activity.<\/p>\n<p>The SumOfUs proposal would force Apple\u2019s board to prepare an annual report on the company\u2019s policies relating to freedom of expression and access to information. The board would be compelled to state in the report whether they are \u201cpublicly committed to freedom of expression and access to information\u201d.<\/p>\n<p>They would also have to disclose a \u201cdescription of the actions Apple has taken in the past year in response to government or third-party demands that were reasonably likely to limit free expression or access to information\u201d.<\/p>\n<p>SumOfUs believes the need to clarify Apple\u2019s relationship with China is made particularly urgent by public outrage surrounding Beijing\u2019s treatment of Uighur people sent to internment camps and pro-democracy protesters in Hong Kong.<\/p>\n<p>Despite backing from ISS and Glass Lewis, SumOfUs still faces an uphill battle to pass the motion because it is opposed by Apple\u2019s board, which includes the company\u2019s chief executive, Tim Cook, and former US vice-president Al Gore.<\/p>\n<p>Apple has issued a statement saying the proposal is \u201cunnecessary based on the extensive information that is already publicly provided to our shareholders and users\u201d.<\/p>\n<p>The company currently publishes transparency data disclosing the number of government requests it receives by country for customer data and app removal.<\/p>\n<p>For instance, Apple reported that between January and June last year, 288 apps were removed in mainland China for \u201clegal\u201d or \u201cplatform\u201d violation. Apple stated that the majority of these requests related to pornography, \u201cillegal content\u201d and gambling.<\/p>\n<p>But in its report to investors, ISS noted that the \u201cquantitative approach to the company\u2019s transparency report provides little context for the app removal requests from the Chinese government or explanation of the risks that may be involved\u201d.<\/p>\n<p>Apple said in its statement that free expression \u201cis central to our company and its success\u201d but that it is obliged to \u201ccomply with local laws and to protect the safety of our customers and employees\u201d, including by removing apps.<\/p>\n<p>The company said: \u201c[W]hile we may disagree with certain decisions at times, we do not believe it would be in the best interests of our users to simply abandon markets, which would leave consumers with fewer choices and fewer privacy protections.\u201d<\/p>\n<p> READ MORE <a
