{"id":3221,"date":"2018-06-15T21:45:03","date_gmt":"2018-06-15T21:45:03","guid":{"rendered":"https:\/\/kasperskycontenthub.com\/threatpost\/?p=132875"},"modified":"2018-06-15T21:45:03","modified_gmt":"2018-06-15T21:45:03","slug":"vermont-librarian-wins-small-claims-suit-against-equifax","status":"publish","type":"post","link":"https:\/\/www.threatshub.org\/blog\/vermont-librarian-wins-small-claims-suit-against-equifax\/","title":{"rendered":"Vermont Librarian Wins Small-Claims Suit Against Equifax"},"content":{"rendered":"<div class=\"media_block\"><\/div>\n<p>In a David-and-Goliath moment, a 49-year-old librarian has won damages against credit giant Equifax, in the wake of its head-spinningly massive 2017 data breach.<\/p>\n<p>It\u2019s a small but significant victory: a small claims court <a href=\"http:\/\/www.vnews.com\/Vermont-small-claims-judge-orders-Equifax-to-pay-Jessamyn-West-$600-18140941\">awarded $600<\/a> to Jessamyn West, native of the small town of Randolph in Orange County, Vermont.<\/p>\n<p>West told Threatpost in a phone interview that she filed the claim herself in her local courthouse, asking for $5,000 for speculative damages. The idea was to pay for future expenses for the LifeLock ID theft service and credit-monitoring for herself and family members. However, that sort of future expense modeling isn\u2019t allowed in small claims court. Instead of dismissing the case, the reduced sum represents what a year of LifeLock ($360) and the identity monitoring ($240) would have cost her for a year going back to when the breach happened.<\/p>\n<p>West, who in addition to being a librarian is a <a href=\"http:\/\/jessamyn.info\/\">social activist and speaker on issues around the digital divide, privacy and other technology issues<\/a>, said that in the wake of the breach, she noticed a palpable sense of impotence when it came to people affected by the incident.<\/p>\n<div id=\"attachment_132882\" class=\"wp-caption alignright\"><a href=\"https:\/\/media.kasperskycontenthub.com\/wp-content\/uploads\/sites\/31\/2018\/06\/15172443\/jessamyn-west1.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-132882 size-medium\" src=\"https:\/\/media.kasperskycontenthub.com\/wp-content\/uploads\/sites\/31\/2018\/06\/15172443\/jessamyn-west1-300x91.jpg\" alt=\"\" width=\"300\" height=\"91\"\/><\/a><\/p>\n<p class=\"wp-caption-text\">Jessamyn West, librarian and technology advocate, at home in Vermont.<\/p>\n<\/div>\n<p>Equifax, which reported more than $3.4 billion in revenue last year, <a href=\"https:\/\/threatpost.com\/equi-facts-equifax-clarifies-the-numbers-for-its-massive-breach\/131797\/\">recently clarified<\/a> that the number of impacted U.S. consumers from the infamous breach now totals about 147.9 million. The breach has touched almost every adult in the U.S., with more than 45 percent of the population directly affected by the incident. Information stolen included names, Social Security numbers, dates of birth, addresses, emails, gender and more.<\/p>\n<p>\u201cThe reporting around it was along the lines of, \u2018everyone\u2019s in trouble, and you can do nothing!\u201d she told us. \u201cThe stories weren\u2019t geared towards the average computer user, and there seemed to be a lot of people who want to foment fear and uncertainty. I wanted to provide some kind of alternative, to show that we don\u2019t have to sit there and take it. We do have some things that work for us, like the court system. Small claims is made for people to get redress, even from giant corporations that don\u2019t care about one person\u2019s private problems.\u201d<\/p>\n<p>West said that she was influenced in her decision to file suit by a <a href=\"https:\/\/www.usatoday.com\/story\/tech\/news\/2017\/09\/13\/want-equifax-pay-bot-helps-victims-file-15-000-small-claims-suit\/663102001\/\">news story<\/a> about a 20-year-old Stanford University student who created a free online bot to help users take cases to small claims court.<\/p>\n<p>\u201cBut it was only for California and New York,\u201d she said. \u201cBut I thought, small claims can\u2019t be that difficult, right? I felt that anyone can do it, because the system is there for anyone to use. There was a website that kind of stepped me through it, and after a little bit of time and a little bit of money \u2014 $90 \u2013 I filed.\u201d<\/p>\n<p>Her win however came as a surprise.<\/p>\n<p>\u201cStunned may be too strong a word \u2013 or maybe it isn\u2019t,\u201d she said. \u201cI really didn\u2019t expect to win anything \u2013 I knew some people had won but they seemed more \u2018lawyery\u2019 than me. My friends thought there was no way. And when I emailed the Equifax paralegal, he said \u2018we\u2019ve won every single one except the three you read about in the paper.&#8217;\u201d<\/p>\n<p>In the end however, West prevailed. She said she plans to donate the money to the Vermont chapter of the American Civil Liberties Union (ACLU), and added that she hopes her case inspires others to stand up and use their civic rights in cases like this.<\/p>\n<p>\u201cMy whole point was about having a better story to talk about instead of feeling like there\u2019s nothing you can do \u2013 raising awareness of online privacy and how it\u2019s possible to deal with big stupid companies doing big stupid things,\u201d she told Threatpost. \u201cMy neighbors were like, way to go! It\u2019s nice to see someone doing something! On Reddit, a lot of the comments are along the lines of \u2018wow, maybe I can I do this, how does that work?\u2019 People really find a lot of these systems completely inscrutable. But the reality is that small claims is available to you in every state, for a little money and some paperwork.\u201d<\/p>\n<p>Equifax faces a handful of individual cases, along with at least two class action suits, both filed in Atlanta, the company\u2019s hometown. One <a href=\"https:\/\/www.kiplinger.com\/article\/credit\/T017-C000-S002-get-in-on-a-class-action-lawsuit-against-equifax.html\">consolidates<\/a> more than 240 lawsuits seeking class-action status that were filed against Equifax within weeks of the breach notification.<\/p>\n<p>Another <a href=\"http:\/\/www.smallbusinessequifaxclass.com\/\">argues<\/a> that an estimated 28 million small business operators face special risk in terms of the cost of Equifax business reports, the availability of credit and exposure to business identity theft, which often is directly linked for small business owners to their personal credit.<\/p>\n<p>READ MORE <a href=\"https:\/\/threatpost.com\/vermont-librarian-wins-small-claims-suit-against-equifax\/132875\/\">HERE<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>In a David-and-Goliath moment, the 49-year-old librarian has won satisfaction in the wake of its head-spinningly massive 2017 data breach.
