This week the company struck a major deal with the Federal Trade Commission (FTC) that could result in a modest payout for impacted consumers.<\/p>\n<p>According to the <a href=\"https:\/\/www.ftc.gov\/news-events\/press-releases\/2019\/07\/equifax-pay-575-million-part-settlement-ftc-cfpb-states-related\" target=\"_blank\" rel=\"noopener noreferrer\">FTC announcement<\/a> and <a href=\"https:\/\/www.ftc.gov\/system\/files\/documents\/cases\/172_3203_equifax_proposed_order_7-22-19.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">order<\/a>, the settlement will result in Equifax paying between $575 and $700 million to settle charges brought by the FTC. $380 million of that total will be assigned to a Consumer Restitution Fund and doled out directly to consumers.<\/p>\n<p>Here\u2019s how to get your cut:<\/p>\n<ul>\n<li>First, head to this <a href=\"https:\/\/eligibility.equifaxbreachsettlement.com\/en\/eligibility\" target=\"_blank\" rel=\"noopener noreferrer\">settlement website<\/a> to determine if your data was exposed. Users will have to enter their last name and last six digits of their social security number to confirm they were part of the breach.<\/li>\n<li>If you were one of the 147 million impacted Americans, you\u2019ll need to either <a href=\"http:\/\/www.equifaxbreachsettlement.com\/file-a-claim\" target=\"_blank\" rel=\"noopener noreferrer\">file a claim online<\/a> or print <a href=\"https:\/\/www.equifaxbreachsettlement.com\/admin\/services\/connectedapps.cms.extensions\/1.0.0.0\/5e30940d-7e11-4b49-b115-6d89a16c0e3f_1033_EFX_-_Final_Claim_Form.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">this form<\/a> and mail it in by January 22, 2020. You\u2019ll be able to request either a one-time $125 payout, or 10 years of free credit reporting\u2014assuming you want anything to do with a company that couldn\u2019t protect your personal data in the first place.<\/li>\n<li>Note that you\u2019ll need a <a href=\"https:\/\/www.equifaxbreachsettlement.com\/admin\/services\/connectedapps.cms.extensions\/1.0.0.0\/6574a180-64d4-43a6-b8df-979a4dd1d36e_1033_EFX_-_Minor_Claim_Form.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">special form<\/a> if you were technically a minor at the time that the breach occurred (May 2017). Minors will be able to net 18 years of free credit reporting.<\/li>\n<li>Consumers may be able to get <em>up to $20,000<\/em> if they can provide evidence that the leak of their financial data resulted in &#8220;fraud, identity theft, or other alleged misuse of your personal information fairly traceable to the data breach,\u201d the settlement website states. You\u2019ll need to provide a police report, IRS, or bank letter, and may be reimbursed to the tune of \u201c$25 per hour for up to 20 hours\u201d if you\u2019ve spent any time trying to resolve identity theft damage.<\/li>\n<\/ul>\n<p>According to a <a href=\"https:\/\/www.equifaxbreachsettlement.com\/faq\" target=\"_blank\" rel=\"noopener noreferrer\">settlement FAQ<\/a>, it could take several months for impacted users to see payouts. There\u2019s additional detail over at the <a href=\"https:\/\/www.ftc.gov\/enforcement\/cases-proceedings\/refunds\/equifax-data-breach-settlement\" target=\"_blank\" rel=\"noopener noreferrer\">FTC settlement website<\/a>. Users can also contact the Equifax Settlement Administrator at 1-833-759-2982 or by emailing info@EquifaxBreachSettlement.com.<\/p>\n<p>The FTC notes that the entire scandal could have been easily avoided.<\/p>\n<p>Equifax waited 40 days before even announcing the company had been hacked. <a href=\"https:\/\/www.vice.com\/en_us\/article\/ne3bv7\/equifax-breach-social-security-numbers-researcher-warning\" target=\"_blank\" rel=\"noopener noreferrer\">Motherboard reporting revealed<\/a> that the company\u2019s IT administrators had known about the vulnerability for months before the hack occurred, yet didn\u2019t apply basic patches for at-risk systems.<\/p>\n<p>The vulnerability was simple and easy to exploit. An Equifax website and ACIS database that was supposed to be for internal use only wound up being publicly exposed to the broader internet. A simple <a href=\"https:\/\/www.owasp.org\/index.php\/Forced_browsing\" target=\"_blank\" rel=\"noopener noreferrer\">forced browsing<\/a> attack provided access to social security numbers, full names, birthdates, and partial addresses of millions of Americans.<\/p>\n<p>&#8220;I&#8217;ve seen a lot of bad things, but not this bad,\u201d the security researcher told Motherboard. &#8220;It should&#8217;ve been fixed the moment it was found. It would have taken them five minutes, they could&#8217;ve just taken the site down.\u201d<\/p>\n<p>When executives did find out about the threat, many decided to cash in on the knowledge. Former Equifax Chief Information Officer Jun Ying, for example, was just <a href=\"https:\/\/www.justice.gov\/usao-ndga\/pr\/former-equifax-employee-sentenced-insider-trading\" target=\"_blank\" rel=\"noopener noreferrer\">sentenced to four months in prison<\/a> for insider trading on the news of the breach before it was formally announced. Equifax manager Sudhakar Reddy Bonthu also <a href=\"https:\/\/hotforsecurity.bitdefender.com\/blog\/manager-who-worked-on-equifaxs-breach-website-sentenced-for-insider-trading-20465.html\" target=\"_blank\" rel=\"noopener noreferrer\">pleaded guilty<\/a> to insider trading on the news.<\/p>\n<p>Publicly, Equifax attempted to place the blame <a href=\"https:\/\/www.nytimes.com\/2017\/10\/03\/business\/equifax-congress-data-breach.html\" target=\"_blank\" rel=\"noopener noreferrer\">entirely at the feet of one employee<\/a>, despite the fact that security researchers had discovered a <a href=\"https:\/\/www.vice.com\/en_us\/article\/ne3bv7\/equifax-breach-social-security-numbers-researcher-warning\" target=\"_blank\" rel=\"noopener noreferrer\">wide variety of additional bugs and vulnerabilities<\/a> that could have just as easily exposed sensitive user data.<\/p>\n<p>According to the FTC, Equifax failed to implement a policy to ensure security vulnerabilities were patched, failed to segment its database services to block access to other parts of the network should it be breached, and failed to install \u201crobust intrusion detection protections\u201d for its legacy databases. Sensitive data, like Social Security numbers, were also stored in plain text.<\/p>\n<p>\u201cCompanies that profit from personal information have an extra responsibility to protect and secure that data,\u201d FTC Chairman Joe Simons said of the settlement. \u201cThis settlement requires that the company take steps to improve its data security going forward, and will ensure that consumers harmed by this breach can receive help protecting themselves from identity theft and fraud.\u201d<\/p>\n<p>While a record payout, the FTC settlement still doesn\u2019t match the scale of Equifax\u2019s incompetence, or the potential harm done to users who may have had their identities stolen as a result of the breach, <a href=\"https:\/\/krebsonsecurity.com\/2019\/07\/what-you-should-know-about-the-equifax-data-breach-settlement\/\" target=\"_blank\" rel=\"noopener noreferrer\">according to security experts like Brian Krebs<\/a>.<\/p>\n<p>\u201cA company that truly offered to pay consumers anywhere near what their data is actually worth would probably wipe these digital dinosaurs from the face of the earth,\u201d
