The Brit, who was at the time trying to fly back home to Blighty after attending the Black Hat and DEF CON security conferences, was <a target=\"_blank\" href=\"https:\/\/www.theregister.co.uk\/2017\/08\/14\/hutchins_court_plea\/\">accused<\/a> of creating and selling the Kronos banking trojan, and denied any wrongdoing.<\/p>\n<p>The US government <a target=\"_blank\" href=\"https:\/\/www.theregister.co.uk\/2018\/06\/07\/wannacry_reverse_engine_marcus_hutchins_hit_with_fresh_charges\/\">subsequently piled on charges<\/a>, and it now appears that the pressure has been too much: on Friday this week, Hutchins accepted a <a target=\"_blank\" href=\"https:\/\/regmedia.co.uk\/2019\/04\/19\/plea.pdf\">plea deal<\/a> [PDF], and admitted two charges of malware development.<\/p>\n<p>&#8220;I\u2019ve pleaded guilty to two charges related to writing malware in the years prior to my career in security,&#8221; he said in a <a target=\"_blank\" rel=\"nofollow\" href=\"https:\/\/www.malwaretech.com\/public-statement\">statement<\/a>.<\/p>\n<div class=\"promo_article\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/regmedia.co.uk\/2017\/08\/05\/marcus_hutchins.jpg?x=174&amp;y=115&amp;crop=1\" width=\"174\" height=\"115\" alt=\"hutchins\"><\/p>\n<h2 title=\"Scrap accused Brit's chat transcript, court urged\">Lawyers for Marcus Hutchins: His &#8216;I made malware&#8217; jail phone call isn&#8217;t proper evidence<\/h2>\n<p><a href=\"https:\/\/www.theregister.co.uk\/2018\/05\/16\/hutchins_moves_to_toss_call_records_in_malware_case\/\"><span>READ MORE<\/span><\/a><\/div>\n<p>&#8220;I regret these actions and accept full responsibility for my mistakes. I will continue to devote my time to keeping people safe from malware attacks.&#8221;<\/p>\n<p>Each of the two counts carries a maximum penalty of five years behind bars, a $250,000 fine, and a year of probation. As with most plea deals, he&#8217;s likely to get less than that, though he may still spend some time in an American cooler.<\/p>\n<p>While being held in jail after his arrest, Hutchins <a target=\"_blank\" href=\"https:\/\/www.theregister.co.uk\/2019\/02\/14\/marcus_hutchins_evidence\/\">apparently admitted<\/a> creating the software nasty. According to the Feds, the Brit at one point told an unnamed associate over a recorded telephone line: &#8220;I used to write malware, they picked me up on some old shit,&#8221; later adding: &#8220;I wrote code for a guy a while back who then incorporated it into a banking malware.&#8221;<\/p>\n<p>Now the FBI have their guilty plea, and Hutchins \u2013 a professional malware reverse-engineer these days \u2013 is facing an uncertain future. But you have to wonder if it was all really worth it for the US authorities. After all, plenty of today&#8217;s cyber-security engineers and researchers have toyed with writing malware, even for research purposes.
