{"id":24906,"date":"2019-02-01T12:47:09","date_gmt":"2019-02-01T12:47:09","guid":{"rendered":"https:\/\/www.threatshub.org\/blog\/uk-spy-overseer-snoopers-charter-cockups-are-still-getting-innocents-arrested\/"},"modified":"2019-02-01T12:47:09","modified_gmt":"2019-02-01T12:47:09","slug":"uk-spy-overseer-snoopers-charter-cockups-are-still-getting-innocents-arrested","status":"publish","type":"post","link":"https:\/\/www.threatshub.org\/blog\/uk-spy-overseer-snoopers-charter-cockups-are-still-getting-innocents-arrested\/","title":{"rendered":"UK spy overseer: Snooper&#8217;s Charter cockups are still getting innocents arrested"},"content":{"rendered":"<div><img decoding=\"async\" src=\"https:\/\/regmedia.co.uk\/2017\/05\/04\/arrest_shutterstock.jpg\" class=\"ff-og-image-inserted\"\/><\/div>\n<p>Police employees who make typos in warrants to use Snooper\u2019s Charter spy powers are still getting innocent people arrested, the Investigatory Powers Commissioner\u2019s delayed annual report has revealed.<\/p>\n<p>Of the 18 \u201cerror investigations\u201d carried out by the Investigatory Powers Commissioner\u2019s Office (IPCO) into the misuse of legal snooping powers by State agencies, the vast majority of wrongful police raids and arrests came about because police workers transposed vital data (such as dates, times or IP addresses) or even made careless typos when writing out applications for search warrants.<\/p>\n<p>These blunders led to innocent people being arrested and accused by police of the most vile crimes \u2013 people such as Nigel Lang, whose <a target=\"_blank\" rel=\"nofollow\" href=\"https:\/\/www.buzzfeed.com\/matthewchampion\/this-mans-life-was-destroyed-by-a-police-typo\">life was blighted for two years after a typo led a police raid, wholly wrongly, to his home<\/a> on suspicion that he was a paedophile.<\/p>\n<p>Lang\u2019s case was mentioned in an anonymised form in IPCO\u2019s <a target=\"_blank\" rel=\"nofollow\" href=\"https:\/\/www.ipco.org.uk\/Default.aspx?mid=4.22\">delayed 2017 report<\/a> [<a target=\"_blank\" rel=\"nofollow\" href=\"https:\/\/www.ipco.org.uk\/docs\/IPCO%20Annual%20Report%202017%20Web%20Accessible%20Version%2020190131.pdf\">PDF<\/a>] which was laid before Parliament yesterday. Hertfordshire Police later confessed they added a digit to an IP address by mistake, leading them to wrongly identify Lang and send South Yorkshire Police, his local force, after him. Herts paid \u00a360,000 in compensation once Lang identified who was responsible.<\/p>\n<h3 class=\"crosshead\"><span>Generally, everything\u2019s OK<\/span><\/h3>\n<p>As well as keeping an eye on police uses of the Snooper\u2019s Charter (perhaps better known nowadays as the <a target=\"_blank\" href=\"http:\/\/www.legislation.gov.uk\/uksi\/2018\/652\/made\">Investigatory Powers Act<\/a>), IPCO also oversees MI5, MI6, local councils, fire and ambulance services, and a whole host of other State bodies who have the legal right to spy on your phonecalls and internet use.<\/p>\n<p>Encouragingly, Lord Justice Adrian Fulford, the Investigatory Powers Commissioner, found that \u201cmany local authorities are using their directed surveillance powers less frequently than a decade ago\u201d and that most fire brigades and ambulance services weren\u2019t doing any snooping at all.<\/p>\n<p>However, Hammersmith Council wins the inglorious title of \u201cBritain\u2019s Creepiest Council\u201d from <em>The Register<\/em> after applying to get its greasy fingers on an average of 79 pieces of communications data about local residents it decided to target.<\/p>\n<p>While IPCO criticised GCHQ for not always setting out \u201cthe scale of the planned surveillance sufficiently and therefore the likely level of intrusion\u201d in its surveillance warrants, and also raised questions about the use of \u201cparties acting on GCHQ\u2019s behalf\u201d (ie, contractors doing work for the agency), it praised the agency for later cleaning up its act and \u201cproviding a succinct summary of the relevant considerations\u201d.<\/p>\n<p>MI5, on the other hand, had a tendency to use \u201cboilerplate text in applications\u201d, according to IPCO, rather than making each application for surveillance on its merits.<\/p>\n<p>Government hackers and bug-planters broke the law 83 times during 2017-18 while carrying out \u201cproperty interference\u201d, IPCO found.<\/p>\n<p>In light of recent concern about police deploying uncontrolled facial recognition technology, IPCO offered little comfort, however, with Lord Justice Fulford writing: \u201cThere has been some recent controversy regarding the use of facial software by police forces. I oversee any conduct that requires surveillance authorisation, but neither Parliament nor the courts have yet established a framework against which to judge this particular activity.\u201d<\/p>\n<p>On the whole, most of the cases where surveillance had not complied with the law and IPSO itself had investigated were caused by human error \u2013 though some were most
